Odluka slovenske vlade kojom se nenošenje maske za zaštitu od koronavirusa kao prekršaj kažnjava globom od 400 eura dovedena je u Sloveniji u pitanje nakon što je jedan sud pravomoćnom presudom presudio da ona nema pravnog temelja.

Vladina odluka, pri čemu se ona pozivala na zakon o zaraznim bolestima, nema pravno utemeljenje u spomenutom zakonu, presudio je sud u Kopru u presudi izrečenoj u vezi žalbe muškarca koji je kažnjen zbog nenošenja maske u vrijeme epidemije Covida-19. Sud je dodao da država u svojim propisima o kažnjavanju građana mora biti precizna.

Pri izricanju globe za nenošenje maski država se pozivala na zakonske restrikcije koje se u epidemiji odnose na kretanje ljudi, a ne na nošenje maski, što vlada u toj odredbi nije ni specificirala.

Ustavni pravnik Andraž Teršek izjavio je da bi odluka suda u Kopru mogla biti presedan zbog čega bi moglo pasti u vodu nekoliko tisuća izrečenih globi za nenošenje maske jer bi svi koji su zbog toga kažnjeni mogli tražiti povrat novca, objavili su slovenski mediji. Mediji dodaju da je moguće alternativno rješenje da se sve do sada izrečene kazne ponište.

Koliko se mjera obveznog nošenja maski do sada strogo primjenjivala svjedoči slučaj ravnatelja slovenskog Instituta za javno zdravlje (NIJZ) Milana Kreka, koji je početkom siječnja morao platiti 400 eura, kad je zaboravio staviti masku dok je točio gorivo na putu iz Ljubljane u Kopar, nakon cjelodnevnog posla. Slično se dogodilo i pred novu godinu na godišnjem domjenku obavještajne službe SOVA, kad je nekoliko njenih službenika zatečeno bez maske u zatvorenom prostoru.

Odluka slovenske vlade kojom se nenošenje maske za zaštitu od koronavirusa kao prekršaj kažnjava globom od 400 eura dovedena je u Sloveniji u pitanje nakon što je jedan sud pravomoćnom presudom presudio da ona nema pravnog temelja.

Vladina odluka, pri čemu se ona pozivala na zakon o zaraznim bolestima, nema pravno utemeljenje u spomenutom zakonu, presudio je sud u Kopru u presudi izrečenoj u vezi žalbe muškarca koji je kažnjen zbog nenošenja maske u vrijeme epidemije Covida-19. Sud je dodao da država u svojim propisima o kažnjavanju građana mora biti precizna.

Pri izricanju globe za nenošenje maski država se pozivala na zakonske restrikcije koje se u epidemiji odnose na kretanje ljudi, a ne na nošenje maski, što vlada u toj odredbi nije ni specificirala.

Ustavni pravnik Andraž Teršek izjavio je da bi odluka suda u Kopru mogla biti presedan zbog čega bi moglo pasti u vodu nekoliko tisuća izrečenih globi za nenošenje maske jer bi svi koji su zbog toga kažnjeni mogli tražiti povrat novca, objavili su slovenski mediji. Mediji dodaju da je moguće alternativno rješenje da se sve do sada izrečene kazne ponište.

Koliko se mjera obveznog nošenja maski do sada strogo primjenjivala svjedoči slučaj ravnatelja slovenskog Instituta za javno zdravlje (NIJZ) Milana Kreka, koji je početkom siječnja morao platiti 400 eura, kad je zaboravio staviti masku dok je točio gorivo na putu iz Ljubljane u Kopar, nakon cjelodnevnog posla. Slično se dogodilo i pred novu godinu na godišnjem domjenku obavještajne službe SOVA, kad je nekoliko njenih službenika zatečeno bez maske u zatvorenom prostoru.

Sud u Kopru donio presudu - kažnjavanje za nenošenje maske je bez pravnog temelja! Slovenci koji su platili globu od 400 eura, sad mogu tražiti povrat novca

Odluka slovenske vlade kojom se nenošenje maske za zaštitu od koronavirusa kao prekršaj kažnjava globom od 400 eura dovedena je u Sloveniji u pitanje nakon što je jedan sud pravomoćnom presudom presudio da ona nema pravnog temelja.

Vladina odluka, pri čemu se ona pozivala na zakon o zaraznim bolestima, nema pravno utemeljenje u spomenutom zakonu, presudio je sud u Kopru u presudi izrečenoj u vezi žalbe muškarca koji je kažnjen zbog nenošenja maske u vrijeme epidemije Covida-19. Sud je dodao da država u svojim propisima o kažnjavanju građana mora biti precizna.

Pri izricanju globe za nenošenje maski država se pozivala na zakonske restrikcije koje se u epidemiji odnose na kretanje ljudi, a ne na nošenje maski, što vlada u toj odredbi nije ni specificirala.
