Država koju zastupa ŽDO Šibenik nikako nema sreće s regresnom tužbom koju je podignula protiv Ivice Petrića, nekadašnjeg pripadnika HV-a koji je bio pravomoćno osuđen na šest godina zatvora za ubojstvo tada 80-godišnjeg Đurada Čanka, sredinom kolovoza 1995. godine u selu Zrmanji, u zaseoku Potoku.

Čanak je ubijen tri dana nakon "Oluje", a Petrić je tada bio mobilizirani pripadnik 15. domobranske pukovnije HV-a u "čišćenju terena" od zaostalih srbo-četničkih formacija.

Po presudi, Petrić je, nakon saznanja da su njegovi suborci kod Čanka pronašli i oduzeli dvije lovačke puške – iako je puške od njega prethodno tražio baš Petrić, a ovaj mu je rekao da ih nema – prema 80-godišnjaku ispalio više hitaca iz pištolja koji su ga pogodili u noge i ruke te prsa.

Pravomoćno

Naime, nakon pravomoćne presude Petriću, članovima obitelji pokojnoga država je, na temelju presude Općinskog suda u Zagrebu od 22. studenoga 2007., a koja je postala pravomoćna 9. rujna 2008. godine, na ime naknade štete s kamatama i troškovima postupka u prosincu 2008. godine isplatila ukupno 1.135.016,03 kune.

I, naravno, država je odlučila tužbom od Petrića nadoknaditi novac koji je isplatila. Prije negoli su podignuli tužbu, obratili su se Petriću 21. travnja 2009. godine zahtjevom za mirno rješenje spora, na koji nije odgovoreno u zakonskom roku. No, država je preko ŽDO-a Šibenik 15. lipnja 2009. godine pokrenula regresnu tužbu, koja je, pak, odbačena rješenjem Županijskog suda u Šibeniku 29. veljače 2016. godine, i to zato jer od podnošenja zahtjeva za mirno rješenje spora pa do podnošenja navedene regresne tužbe nije protekao rok od tri mjeseca.

Nakon te prve neuspjele tužbe, koja je, dakle, podnesena prerano, ŽDO Šibenik 7. ožujka 2016. godine podnosi novu tužbu radi naknade štete u istom iznosu protiv Petrića. No, u svibnju ove godine Općinski sud u Šibeniku nepravomoćnom odlukom opet odbija tužbeni zahtjev kao neosnovan, i to zbog toga jer je podnesen, kako je to obrazložio sudac Toni Grgurin, kad je već nastupila zastara.

Zastara

– Ovaj sud je utvrđenja da je zastarni rok u konkretnom slučaju počeo teći popravljanjem predmetne štete prouzročene bliskim srodnicima oštećenog Đurada Čanka po tužiteljici, tj. dana 20. prosinca 2008. godine (odnosno dan nakon isplate navedenim oštećenicima). Zastoj zastare u konkretnom slučaju trajao je od 21. travnja 2009. godine do 21. srpnja 2009. godine, odnosno tijekom postupka povodom zahtjeva za mirno rješenje spora podnesenog tuženiku od strane tužiteljice, a na koji tuženik nije odgovorio. Rečeni zastarni rok nastavio je teći te je potom istekao 20. rujna 2009. godine, slijedom čega je potraživanje tužiteljice (države) u konkretnom slučaju podnošenjem tužbe ovom sudu dana 7. ožujka 2016. godine zastarjelo – napisao je, među ostalim, sudac u obrazloženju presude.

Ostaje nam vidjeti hoće li se s njegovim stajalištem složiti i drugostupanjski sud.

Sam Petrić nikad nije priznao ubojstvo, a pokušao je i dobiti obnovu kaznenog postupka navodeći da je za djelo za koje je u Hrvatskoj osuđen vođen postupak i pred Međunarodnim sudom u Haagu (Gotovina i Markač) te je tamo pravomoćno oslobođen. Petrić smatra da je on, kao pripadnik HV-a, prema definiciji iz prvostupanjske presude pred MKSJ, imao status sudionika udruženog zločinačkog pothvata, odnosno, prema njegovu shvaćanju, Haaški sud je kazneno djelo za koje je on proglašen krivim isto svrstao u ratni zločin, u sklopu šireg rasprostranjenog napada na civilno stanovništvo. Vrhovni sud odbio je njegov zahtjev.

Država koju zastupa ŽDO Šibenik nikako nema sreće s regresnom tužbom koju je podignula protiv Ivice Petrića, nekadašnjeg pripadnika HV-a koji je bio pravomoćno osuđen na šest godina zatvora za ubojstvo tada 80-godišnjeg Đurada Čanka, sredinom kolovoza 1995. godine u selu Zrmanji, u zaseoku Potoku.

Čanak je ubijen tri dana nakon "Oluje", a Petrić je tada bio mobilizirani pripadnik 15. domobranske pukovnije HV-a u "čišćenju terena" od zaostalih srbo-četničkih formacija.

Po presudi, Petrić je, nakon saznanja da su njegovi suborci kod Čanka pronašli i oduzeli dvije lovačke puške – iako je puške od njega prethodno tražio baš Petrić, a ovaj mu je rekao da ih nema – prema 80-godišnjaku ispalio više hitaca iz pištolja koji su ga pogodili u noge i ruke te prsa.

Pravomoćno

Naime, nakon pravomoćne presude Petriću, članovima obitelji pokojnoga država je, na temelju presude Općinskog suda u Zagrebu od 22. studenoga 2007., a koja je postala pravomoćna 9. rujna 2008. godine, na ime naknade štete s kamatama i troškovima postupka u prosincu 2008. godine isplatila ukupno 1.135.016,03 kune.

I, naravno, država je odlučila tužbom od Petrića nadoknaditi novac koji je isplatila. Prije negoli su podignuli tužbu, obratili su se Petriću 21. travnja 2009. godine zahtjevom za mirno rješenje spora, na koji nije odgovoreno u zakonskom roku. No, država je preko ŽDO-a Šibenik 15. lipnja 2009. godine pokrenula regresnu tužbu, koja je, pak, odbačena rješenjem Županijskog suda u Šibeniku 29. veljače 2016. godine, i to zato jer od podnošenja zahtjeva za mirno rješenje spora pa do podnošenja navedene regresne tužbe nije protekao rok od tri mjeseca.

Nakon te prve neuspjele tužbe, koja je, dakle, podnesena prerano, ŽDO Šibenik 7. ožujka 2016. godine podnosi novu tužbu radi naknade štete u istom iznosu protiv Petrića. No, u svibnju ove godine Općinski sud u Šibeniku nepravomoćnom odlukom opet odbija tužbeni zahtjev kao neosnovan, i to zbog toga jer je podnesen, kako je to obrazložio sudac Toni Grgurin, kad je već nastupila zastara.

Zastara

– Ovaj sud je utvrđenja da je zastarni rok u konkretnom slučaju počeo teći popravljanjem predmetne štete prouzročene bliskim srodnicima oštećenog Đurada Čanka po tužiteljici, tj. dana 20. prosinca 2008. godine (odnosno dan nakon isplate navedenim oštećenicima). Zastoj zastare u konkretnom slučaju trajao je od 21. travnja 2009. godine do 21. srpnja 2009. godine, odnosno tijekom postupka povodom zahtjeva za mirno rješenje spora podnesenog tuženiku od strane tužiteljice, a na koji tuženik nije odgovorio. Rečeni zastarni rok nastavio je teći te je potom istekao 20. rujna 2009. godine, slijedom čega je potraživanje tužiteljice (države) u konkretnom slučaju podnošenjem tužbe ovom sudu dana 7. ožujka 2016. godine zastarjelo – napisao je, među ostalim, sudac u obrazloženju presude.

Ostaje nam vidjeti hoće li se s njegovim stajalištem složiti i drugostupanjski sud.

Sam Petrić nikad nije priznao ubojstvo, a pokušao je i dobiti obnovu kaznenog postupka navodeći da je za djelo za koje je u Hrvatskoj osuđen vođen postupak i pred Međunarodnim sudom u Haagu (Gotovina i Markač) te je tamo pravomoćno oslobođen. Petrić smatra da je on, kao pripadnik HV-a, prema definiciji iz prvostupanjske presude pred MKSJ, imao status sudionika udruženog zločinačkog pothvata, odnosno, prema njegovu shvaćanju, Haaški sud je kazneno djelo za koje je on proglašen krivim isto svrstao u ratni zločin, u sklopu šireg rasprostranjenog napada na civilno stanovništvo. Vrhovni sud odbio je njegov zahtjev.

Država koju zastupa ŽDO Šibenik nikako nema sreće s regresnom tužbom koju je podignula protiv Ivice Petrića, nekadašnjeg pripadnika HV-a koji je bio pravomoćno osuđen na šest godina zatvora za ubojstvo tada 80-godišnjeg Đurada Čanka, sredinom kolovoza 1995. godine u selu Zrmanji, u zaseoku Potoku.

Čanak je ubijen tri dana nakon "Oluje", a Petrić je tada bio mobilizirani pripadnik 15. domobranske pukovnije HV-a u "čišćenju terena" od zaostalih srbo-četničkih formacija.

Po presudi, Petrić je, nakon saznanja da su njegovi suborci kod Čanka pronašli i oduzeli dvije lovačke puške – iako je puške od njega prethodno tražio baš Petrić, a ovaj mu je rekao da ih nema – prema 80-godišnjaku ispalio više hitaca iz pištolja koji su ga pogodili u noge i ruke te...
