Priča Frane Brnade (85) koji je u Milićevoj ulici u Splitu, sklopivši ugovor o zakupu na određeno vrijeme, iznajmio četverokatnicu s deset apartmana jednoj romskoj obitelji da se bave turizmom, a kad su mu prestali plaćati najam, nije mogao ući u svoju kuću, iz koje su oni izišli tek nakon isteka petogodišnjeg najma i ostavivši potpuno devastiran objekt iza sebe, zasigurno nije jedini takav slučaj u Splitu i šire.
Možda jest jedan od drastičnijih, no za mnoge je stanodavce ovakav rasplet kao u slučaju Brnada "noćna mora" koju bi sigurno htjeli izbjeći.
A što učiniti i kako se pravno zaštititi? Naš sugovornik iz splitske priče uredno je sklopio ugovor koji su potpisale obje strane, a u kojem, među ostalim, stoji i da on ima pravo raskinuti ugovor bez otkaznog roka ako mu oni ne plate dvije uzastopne mjesečne najamnine.
No, kad je on pokrenuo sudski postupak za raskidanje ugovora i potraživanje duga, upao je u rupu zvanu hrvatsko pravosuđe.
Zahirovići
Naime, u siječnju 2019. godine Brnada je dobio nepravomoćnu sudsku odluku po kojoj je najmoprimcima Nenadu i Muhamedu Zahiroviću iz Zagreba naloženo da u roku od 15 dana, "slobodne od osoba i stvari", predaju nekretnine u Milićevoj 45 te da Brnadi plate 139 tisuća kuna plus zatezne kamate za neplaćeni najam, troškove vode, struje, komunalija, dug Poreznoj upravi i nešto manje od 21 tisuću kuna sudskih troškova.
Naravno, uslijedila je žalba i predmet još uvijek tavori u nekoj od ladica Županijskog suda u Velikoj Gorici i tko zna kad će doći na red. Za to vrijeme, vidjeli smo, najam je istekao, Zahirovići su otišli ostavivši pustoš iza sebe.
– Idealan način na koji se zakupodavac može pravno zaštititi jest sklapanje solemniziranog ugovora kod javnog bilježnika, no mnogi se ne odlučuju na to jer to iziskuje ekstra novčane izdatke za ovjeru, koji nisu zanemarivi. Ovakav tip ugovora predstavlja ovršnu ispravu, odnosno zamjenu za pravomoćnu presudu, i na temelju takvog ugovora odmah se može ići na sudsku ovrhu radi iseljenja i ovrhu radi naplate najamnine i zakupnine i pripadajućih troškova režija. Dakle, s ovim se ugovorom preskače sudovanje, odnosno parnice koje znaju potrajati godinama – objašnjava nam splitski odvjetnik Toni Vukičević.

Postoji i mogućnost da se kod najma može ugovoriti i iznos pologa na ime osiguranja od neplaćanja i eventualne nastale štete.
Jedna njegova splitska kolegica koja se niz godina bavi ovom problematikom, ali ne voli medijsko eksponiranje, objašnjava nam da u slučaju kad ugovor nije solemniziran i samim tim ne predstavlja ovršnu ispravu, treba provesti sudski postupak radi iseljenja i namirenja duga.
Dakle, treba čekati da "superbrzo" pravosuđe donese pravomoćnu odluku i tek se onda može ići na ovrhu. Koja, pak, u slučaju našeg 85-godišnjaka nema više smisla jer su najmoprimci izišli iz nekretnine. Može se i prilikom najma ugovoriti dio osigurnine kao polog, odnosno depozit u slučaju da nastane određena šteta.
Ako nema novca...
– Kod štete polog može malo spasiti stvar, ali svakako bi trebalo povremeno tražiti da se nekretnina obiđe, da se utvrdi stanje.
To pravo propisuje Zakon o najmu stanova, u kojem stoji da vlasnik u svako doba uz najavu može tražiti pregled nekretnine. Zakon o zakupu poslovnog prostora to ne omogućava, ali nema zapreke da se to uglavi u ugovor. Ova solucija može biti kao neki tihi pritisak i kontrola, a ne da se dogodi da nakon dvije godine dođeš u nekretninu i padneš u nesvijest od zapuštenosti.
A ako se to ipak dogodi, kao u ovom slučaju o kojem ste pisali, onda je jedina mogućnost da se ustane tužbom radi naknade štete. No, prije toga treba pokrenuti postupak osiguranja dokaza da vještaci utvrde visinu štete. Zašto? Zato što ako vlasnik krene u renoviranje, a postupak se "zakotrlja" tek nakon pola godine ili godinu dana, onda je gotovo nemoguće dokazati vjerodostojno kakva su bila oštećenja.
No, uvijek i u svakoj situaciji ostaje onaj vječni problem – kad presudu dobiješ, ili čak i ako imaš solemniziranu ispravu, problem je, naravno, solventnost i naplata ako dužnik nema novca i imovine – objašnjava naša stručna sugovornica.
Postoje i druge solucije kako izbaciti neželjene podstanare, no one nisu ni pravne ni legalne prirode, pa o njima nećemo govoriti.

Priča Frane Brnade (85) koji je u Milićevoj ulici u Splitu, sklopivši ugovor o zakupu na određeno vrijeme, iznajmio četverokatnicu s deset apartmana jednoj romskoj obitelji da se bave turizmom, a kad su mu prestali plaćati najam, nije mogao ući u svoju kuću, iz koje su oni izišli tek nakon isteka petogodišnjeg najma i ostavivši potpuno devastiran objekt iza sebe, zasigurno nije jedini takav slučaj u Splitu i šire.
Možda jest jedan od drastičnijih, no za mnoge je stanodavce ovakav rasplet kao u slučaju Brnada "noćna mora" koju bi sigurno htjeli izbjeći.
A što učiniti i kako se pravno zaštititi? Naš sugovornik iz splitske priče uredno je sklopio ugovor koji su potpisale obje strane, a u kojem, među ostalim, stoji i da on ima pravo raskinuti ugovor bez otkaznog roka ako mu oni ne plate dvije uzastopne mjesečne najamnine.
No, kad je on pokrenuo sudski postupak za raskidanje ugovora i potraživanje duga, upao je u rupu zvanu hrvatsko pravosuđe.
Zahirovići
Naime, u siječnju 2019. godine Brnada je dobio nepravomoćnu sudsku odluku po kojoj je najmoprimcima Nenadu i Muhamedu Zahiroviću iz Zagreba naloženo da u roku od 15 dana, "slobodne od osoba i stvari", predaju nekretnine u Milićevoj 45 te da Brnadi plate 139 tisuća kuna plus zatezne kamate za neplaćeni najam, troškove vode, struje, komunalija, dug Poreznoj upravi i nešto manje od 21 tisuću kuna sudskih troškova.
Naravno, uslijedila je žalba i predmet još uvijek tavori u nekoj od ladica Županijskog suda u Velikoj Gorici i tko zna kad će doći na red. Za to vrijeme, vidjeli smo, najam je istekao, Zahirovići su otišli ostavivši pustoš iza sebe.
– Idealan način na koji se zakupodavac može pravno zaštititi jest sklapanje solemniziranog ugovora kod javnog bilježnika, no mnogi se ne odlučuju na to jer to iziskuje ekstra novčane izdatke za ovjeru, koji nisu zanemarivi. Ovakav tip ugovora predstavlja ovršnu ispravu, odnosno zamjenu za pravomoćnu presudu, i na temelju takvog ugovora odmah se može ići na sudsku ovrhu radi iseljenja i ovrhu radi naplate najamnine i zakupnine i pripadajućih troškova režija. Dakle, s ovim se ugovorom preskače sudovanje, odnosno parnice koje znaju potrajati godinama – objašnjava nam splitski odvjetnik Toni Vukičević.

Postoji i mogućnost da se kod najma može ugovoriti i iznos pologa na ime osiguranja od neplaćanja i eventualne nastale štete.
Jedna njegova splitska kolegica koja se niz godina bavi ovom problematikom, ali ne voli medijsko eksponiranje, objašnjava nam da u slučaju kad ugovor nije solemniziran i samim tim ne predstavlja ovršnu ispravu, treba provesti sudski postupak radi iseljenja i namirenja duga.
Dakle, treba čekati da "superbrzo" pravosuđe donese pravomoćnu odluku i tek se onda može ići na ovrhu. Koja, pak, u slučaju našeg 85-godišnjaka nema više smisla jer su najmoprimci izišli iz nekretnine. Može se i prilikom najma ugovoriti dio osigurnine kao polog, odnosno depozit u slučaju da nastane određena šteta.
Ako nema novca...
– Kod štete polog može malo spasiti stvar, ali svakako bi trebalo povremeno tražiti da se nekretnina obiđe, da se utvrdi stanje.
To pravo propisuje Zakon o najmu stanova, u kojem stoji da vlasnik u svako doba uz najavu može tražiti pregled nekretnine. Zakon o zakupu poslovnog prostora to ne omogućava, ali nema zapreke da se to uglavi u ugovor. Ova solucija može biti kao neki tihi pritisak i kontrola, a ne da se dogodi da nakon dvije godine dođeš u nekretninu i padneš u nesvijest od zapuštenosti.
A ako se to ipak dogodi, kao u ovom slučaju o kojem ste pisali, onda je jedina mogućnost da se ustane tužbom radi naknade štete. No, prije toga treba pokrenuti postupak osiguranja dokaza da vještaci utvrde visinu štete. Zašto? Zato što ako vlasnik krene u renoviranje, a postupak se "zakotrlja" tek nakon pola godine ili godinu dana, onda je gotovo nemoguće dokazati vjerodostojno kakva su bila oštećenja.
No, uvijek i u svakoj situaciji ostaje onaj vječni problem – kad presudu dobiješ, ili čak i ako imaš solemniziranu ispravu, problem je, naravno, solventnost i naplata ako dužnik nema novca i imovine – objašnjava naša stručna sugovornica.
Postoje i druge solucije kako izbaciti neželjene podstanare, no one nisu ni pravne ni legalne prirode, pa o njima nećemo govoriti.
