Više od dvije godine nakon što je Županijski sud u Osijeku napisao nepravomoćnu osuđujuću presudu protiv Zdravka Mamića i ostalih, te nekoliko dana nakon što je održana drugostupanjska sjednica Vrhovnoga suda na kojoj se odlučivalo o žalbama na tu presudu, osječki Županijski sud danas je jednoj od stranaka, bivšoj supruzi Zorana Mamića, očigledno s dvogodišnjim zakašnjenjem, poslao prvostupanjsku presudu, piše Jutarnji list.
Ovu informaciju potvrdilo nam je nekoliko izvora dobro upoznatih sa slučajem, međutim službenu potvrdu od nadležnih sudova zbog kratkih vremenskih rokova nismo uspjeli dobiti.
Naime, bivša supruga Zorana Mamića Ana Šikić nije bila među okrivljenicima, no ona je jedna od osoba kojima se, prema nepravomoćnoj presudi, treba oduzeti nepripadajuća imovinska korist zbog sumnje da je riječ o sredstvima koja su im dali okrivljenici.
Tako je, između ostaloga, imovinska korist, osim okrivljenicima Zdravku i Zoranu Mamića te porezniku Milanu Pernaru, oduzeta i članovima njihovih obitelji.
Sve te osobe, time što im se oduzima imovina, također postaju stranke u postupku te jednako kao i okrivljenici zaprimaju nepravomoćnu presudu na koju imaju pravo žalbe Vrhovnom sudu.
Na sjednici Vrhovnoga suda nekoliko članova obitelji okrivljenika, odnosno njihovi odvjetnici, tako su i obrazlagali svoje žalbe, a o svim tim žalbama Vrhovni sud naknadno je trebao odlučiti u sklopu svoje odluke o čitavom predmetu.
No, nigdje nije bilo žalbe Ane Mamić.
Izmjenjivali su se tako govori odvjetnika zastupnika pojedinih članova obitelji i Zdravka Mamića, i Milana Pernara, međutim, premda je i ona bila osoba od koje se oduzima imovina, nitko nije nigdje spomenuo Anu Mamić, a sada izgleda da je jasno i zašto.
Naime, čini se da je osječki Županijski sud potpuno zaboravio da je i ona stranka u postupku te joj prije dvije godine nisu poslali presudu kada je poslana ostalim strankama.
Nije to po svemu sudeći isprva vidio niti Vrhovni sud koji je proveo i zaključio javni dio sjednice.
Naknadno shvatili propust
Izgleda da su suci najviše sudske instance tek naknadno vidjeli da im u spisu nema dostavnice za jednu stranku, te su, po svemu sudeći, čitav predmet hitno vratili osječkom Županijskom sudu koji je zatim hitno dvije godine staru presudu poslao Ani Mamić kako bi ona na nju žalila. Posljedice po čitavu presudu za sada se čini nisu nikakve, ali lako je moguće da će Vrhovni sud morati ponoviti sjednicu u slučaju protiv Zdravka i Zorana Mamića, Pernara i Damira Vrbanovića, ovoga puta i sa žalbom i odvjetnikom Ane Mamić. Naravno, ako se ona odluči žaliti.
Naime, njoj sada ostaje mogućnost žalbe za koju ima 15-dnevni rok, te na njezinu žalbu Uskok može odgovoriti. Nakon tako prikupljenih žalbi one ponovno idu na Vrhovni sud koji mora dozvoliti i njezinom odvjetniku da iznese svoju žalbu, a lako se može dogoditi da će se zbog toga ponoviti kompletna sjednica.
S druge strane, da je hipotetski osuđujuća presuda protiv Mamića postala pravomoćna, ovakav propust, odnosno nemogućnost jedne od stranaka da se žali zbog propusta suda, predstavljala bi izvjesno bitnu povredu te bi čitav predmet bio srušen ili u nekom revizijskom postupku ili pak pred Ustavnim sudom.
A riječ je, u odnosu na čitavu inkriminiranu imovinsku korist, zapravo o jako malome dijelu.
Naime, prema nepravomoćnoj presudi, od Zdravka Mamića i članova njegove obitelji trebala se oduzeti imovinska korist od 52 milijuna kuna.
Od Zorana Mamića prema nepravomoćnoj presudi trebalo se pak oduzeti oko 25,89 milijuna kuna od čega je u vlasništvu Ane Mamić bilo blokiranih 6.284 eura u jednoj banci te terenac Land Rover Evoque.

Više od dvije godine nakon što je Županijski sud u Osijeku napisao nepravomoćnu osuđujuću presudu protiv Zdravka Mamića i ostalih, te nekoliko dana nakon što je održana drugostupanjska sjednica Vrhovnoga suda na kojoj se odlučivalo o žalbama na tu presudu, osječki Županijski sud danas je jednoj od stranaka, bivšoj supruzi Zorana Mamića, očigledno s dvogodišnjim zakašnjenjem, poslao prvostupanjsku presudu, piše Jutarnji list.
Ovu informaciju potvrdilo nam je nekoliko izvora dobro upoznatih sa slučajem, međutim službenu potvrdu od nadležnih sudova zbog kratkih vremenskih rokova nismo uspjeli dobiti.
Naime, bivša supruga Zorana Mamića Ana Šikić nije bila među okrivljenicima, no ona je jedna od osoba kojima se, prema nepravomoćnoj presudi, treba oduzeti nepripadajuća imovinska korist zbog sumnje da je riječ o sredstvima koja su im dali okrivljenici.
Tako je, između ostaloga, imovinska korist, osim okrivljenicima Zdravku i Zoranu Mamića te porezniku Milanu Pernaru, oduzeta i članovima njihovih obitelji.
Sve te osobe, time što im se oduzima imovina, također postaju stranke u postupku te jednako kao i okrivljenici zaprimaju nepravomoćnu presudu na koju imaju pravo žalbe Vrhovnom sudu.
Na sjednici Vrhovnoga suda nekoliko članova obitelji okrivljenika, odnosno njihovi odvjetnici, tako su i obrazlagali svoje žalbe, a o svim tim žalbama Vrhovni sud naknadno je trebao odlučiti u sklopu svoje odluke o čitavom predmetu.
No, nigdje nije bilo žalbe Ane Mamić.
Izmjenjivali su se tako govori odvjetnika zastupnika pojedinih članova obitelji i Zdravka Mamića, i Milana Pernara, međutim, premda je i ona bila osoba od koje se oduzima imovina, nitko nije nigdje spomenuo Anu Mamić, a sada izgleda da je jasno i zašto.
Naime, čini se da je osječki Županijski sud potpuno zaboravio da je i ona stranka u postupku te joj prije dvije godine nisu poslali presudu kada je poslana ostalim strankama.
Nije to po svemu sudeći isprva vidio niti Vrhovni sud koji je proveo i zaključio javni dio sjednice.
Naknadno shvatili propust
Izgleda da su suci najviše sudske instance tek naknadno vidjeli da im u spisu nema dostavnice za jednu stranku, te su, po svemu sudeći, čitav predmet hitno vratili osječkom Županijskom sudu koji je zatim hitno dvije godine staru presudu poslao Ani Mamić kako bi ona na nju žalila. Posljedice po čitavu presudu za sada se čini nisu nikakve, ali lako je moguće da će Vrhovni sud morati ponoviti sjednicu u slučaju protiv Zdravka i Zorana Mamića, Pernara i Damira Vrbanovića, ovoga puta i sa žalbom i odvjetnikom Ane Mamić. Naravno, ako se ona odluči žaliti.
Naime, njoj sada ostaje mogućnost žalbe za koju ima 15-dnevni rok, te na njezinu žalbu Uskok može odgovoriti. Nakon tako prikupljenih žalbi one ponovno idu na Vrhovni sud koji mora dozvoliti i njezinom odvjetniku da iznese svoju žalbu, a lako se može dogoditi da će se zbog toga ponoviti kompletna sjednica.
S druge strane, da je hipotetski osuđujuća presuda protiv Mamića postala pravomoćna, ovakav propust, odnosno nemogućnost jedne od stranaka da se žali zbog propusta suda, predstavljala bi izvjesno bitnu povredu te bi čitav predmet bio srušen ili u nekom revizijskom postupku ili pak pred Ustavnim sudom.
A riječ je, u odnosu na čitavu inkriminiranu imovinsku korist, zapravo o jako malome dijelu.
Naime, prema nepravomoćnoj presudi, od Zdravka Mamića i članova njegove obitelji trebala se oduzeti imovinska korist od 52 milijuna kuna.
Od Zorana Mamića prema nepravomoćnoj presudi trebalo se pak oduzeti oko 25,89 milijuna kuna od čega je u vlasništvu Ane Mamić bilo blokiranih 6.284 eura u jednoj banci te terenac Land Rover Evoque.
