Nakon što je izvanredni upravni nadzor Ministarstva rada, mirovinskog sustava, obitelji i socijalne politike utvrdio više nepravilnosti u radu Centra za socijalnu skrb podružnice Maksimir, pjevačica Severina Vučković, koja je tvrdila da su institucije nezakonito postupale u njezinoj borbi za skrbništvo nad sinom, dobila je svojevrsnu satisfakciju.

No još je više nepravilnosti utvrđeno u radu Centra za posebno skrbništvo na koji je pjevačica također ukazivala, njih čak 24, piše Jutarnji list.

Ovaj je Centar osnovan 2014. godine s ciljem da se osnaže prava djece i njihova zaštita. Uloga posebnog skrbnika je da u situacijama konfliktnih odnosa između roditelja zastupa dijete i brine za njegov interes.

Takva je situacija bila u slučaju borbe za skrbništvo između Severine Vučković i njezinog bivšeg partnera Milana Popovića koji se nisu mogli dogovoriti oko skrbništva nad svojim sinom, ali gotovo ni o jednoj drugoj pojedinosti koja se odnosila na odgoj djeteta, od pohađanja vrtića, izbora škole i drugih, pa je njihovu djetetu određena posebna skrbnica.

Ona je, kad je sud 2019. godine donio privremenu mjeru i odredio da će dijete živjeti s ocem, predlagala upravo takvo rješenje pri čemu se priklonila stavu Centra za socijalnu skrb u Maksimiru. Iznijela je takav stav sudu, a da prethodno s djetetom nije čak ni obavila razgovor. Od upućenih u nalaz izvanrednog upravnog nadzora u Centru za posebno skrbništvo doznajemo kako se u njemu ističe da je poseban skrbnik dužan razgovarati s djetetom kad se radi o bitnim važnostima za dijete i omogućiti mu da aktivno sudjeluje u rješavanju o svojim pitanjima.

No nadzor je isto tako pokazao da je premalo posebnih skrbnika te da svaki skrbnik ima po 2500 do 2700 predmeta pa je nemoguće da u svakom slučaju odu na sud, kao ni da razgovaraju s djecom.

Ipak, posebna skrbnica sina Severine Vučković i Milana Popovića u ranijoj je fazi razgovarala s djetetom, no nadzor je pokazao, doznaje Jutarnji, da to nije bilo po pravilima struke. S djetetom je trebala razgovarati sama, bez prisustva drugih osoba, i to u Centru, a razgovor je obavljen u prisustvu ravnateljice Centra i to u očevu stanu. Tvrdilo se kako se s djetetom razgovaralo i u domu majke, ali o tome nije nađen nikakav trag, a i majka je to opovrgla.

Bilo je više pojedinosti za koje se u nadzoru utvrdilo da nisu bile zakonite. Pjevačica je podnijela zahtjev za izuzeće posebne skrbnice i pritom navela kako je protiv nje podnijela kaznenu prijavu i obrazložila razloge. Centar za socijalnu skrb ju je odbio, a pritom joj nije dao mogućnost pravnog lijeka.

Nadzor je, doznajemo, utvrdio kako Centar za posebno skrbništvo nije pravilno postupao, odnosno da nisu prikupili sve podatke vezane za kaznenu prijavu, niti su obavili razgovore s djelatnicima Centra kako bi provjerili činjenice koje je navodila majka. Radilo se o optužbi o neprimjerenoj komunikaciji oca i posebne skrbnice te sukobu interesa. Uostalom, napominju, da je zbog toga što je odnos između majke djeteta i njegove posebne skrbnice bio trajno kontaminiran i postojala je sumnja u nepristranost, Centar trebao sam po službenoj dužnosti podnijeti zahtjev Centru za socijalnu skrb da se djetetu promijeni posebni skrbnik.

Zanimljivo je kako se tijekom nadzora pokazalo da je u propustima sudjelovalo i samo Ministarstvo koje sad vodi ministar Josip Aladrović jer su zahtjev za izvanrednim nadzorom nad radom obaju Centara koji je podnijela Severina Vučković tretirali kao prigovor.

U odnosu na posebnu skrbnicu protiv koje je pjevačica podnijela kaznenu prijavu i koja je na kraju razriješena odlukom Upravnog suda, prema našim informacijama u izvanrednom nadzoru je utvrđeno kako se na sudskom ročištu u studenome 2019. godine priklonila prijedlogu Centra za socijalnu skrb Maksimir da dijete živi s ocem jer majka ne surađuje s institucijama.

Kao zanimljiv detalj upućeni u rezultate nadzora navode podatak da je u lipnju 2020. sutkinja koja je odlučivala o skrbništvu u nazočnosti posebne skrbnice razgovarala s djetetom, da je ono reklo kako želi živjeti s majkom i da sve bude kao i prije, ali je zaključeno da izražavanje i ponašanje djeteta ne odaju sliku njegove autentične želje. O razgovoru je sastavljena zabilješka, ali nije potpisana.

U odnosu na slučaj Severine Vučković, odnosno njezina djeteta, nadzor je prema našim informacijama utvrdio da spis nije vođen po pravilima Uredbe o uredskom poslovanju, da se akti spisa nalaze izvan spisa predmeta, neki u drugim predmetima koji su izuzeti na daljnju obradu, da akti nisu urudžbirani kronološkim redom, da nisu upisani u košuljicu, da nije bilo moguće utvrditi koji akti su sastavni dio spisa, koja je kronologija postupanja te još niz nepravilnosti.

Nakon što je izvanredni upravni nadzor Ministarstva rada, mirovinskog sustava, obitelji i socijalne politike utvrdio više nepravilnosti u radu Centra za socijalnu skrb podružnice Maksimir, pjevačica Severina Vučković, koja je tvrdila da su institucije nezakonito postupale u njezinoj borbi za skrbništvo nad sinom, dobila je svojevrsnu satisfakciju.

No još je više nepravilnosti utvrđeno u radu Centra za posebno skrbništvo na koji je pjevačica također ukazivala, njih čak 24, piše Jutarnji list.

Ovaj je Centar osnovan 2014. godine s ciljem da se osnaže prava djece i njihova zaštita. Uloga posebnog skrbnika je da u situacijama konfliktnih odnosa između roditelja zastupa dijete i brine za njegov interes.

Takva je situacija bila u slučaju borbe za skrbništvo između Severine Vučković i njezinog bivšeg partnera Milana Popovića koji se nisu mogli dogovoriti oko skrbništva nad svojim sinom, ali gotovo ni o jednoj drugoj pojedinosti koja se odnosila na odgoj djeteta, od pohađanja vrtića, izbora škole i drugih, pa je njihovu djetetu određena posebna skrbnica.

Ona je, kad je sud 2019. godine donio privremenu mjeru i odredio da će dijete živjeti s ocem, predlagala upravo takvo rješenje pri čemu se priklonila stavu Centra za socijalnu skrb u Maksimiru. Iznijela je takav stav sudu, a da prethodno s djetetom nije čak ni obavila razgovor. Od upućenih u nalaz izvanrednog upravnog nadzora u Centru za posebno skrbništvo doznajemo kako se u njemu ističe da je poseban skrbnik dužan razgovarati s djetetom kad se radi o bitnim važnostima za dijete i omogućiti mu da aktivno sudjeluje u rješavanju o svojim pitanjima.

No nadzor je isto tako pokazao da je premalo posebnih skrbnika te da svaki skrbnik ima po 2500 do 2700 predmeta pa je nemoguće da u svakom slučaju odu na sud, kao ni da razgovaraju s djecom.

Ipak, posebna skrbnica sina Severine Vučković i Milana Popovića u ranijoj je fazi razgovarala s djetetom, no nadzor je pokazao, doznaje Jutarnji, da to nije bilo po pravilima struke. S djetetom je trebala razgovarati sama, bez prisustva drugih osoba, i to u Centru, a razgovor je obavljen u prisustvu ravnateljice Centra i to u očevu stanu. Tvrdilo se kako se s djetetom razgovaralo i u domu majke, ali o tome nije nađen nikakav trag, a i majka je to opovrgla.

Bilo je više pojedinosti za koje se u nadzoru utvrdilo da nisu bile zakonite. Pjevačica je podnijela zahtjev za izuzeće posebne skrbnice i pritom navela kako je protiv nje podnijela kaznenu prijavu i obrazložila razloge. Centar za socijalnu skrb ju je odbio, a pritom joj nije dao mogućnost pravnog lijeka.

Nadzor je, doznajemo, utvrdio kako Centar za posebno skrbništvo nije pravilno postupao, odnosno da nisu prikupili sve podatke vezane za kaznenu prijavu, niti su obavili razgovore s djelatnicima Centra kako bi provjerili činjenice koje je navodila majka. Radilo se o optužbi o neprimjerenoj komunikaciji oca i posebne skrbnice te sukobu interesa. Uostalom, napominju, da je zbog toga što je odnos između majke djeteta i njegove posebne skrbnice bio trajno kontaminiran i postojala je sumnja u nepristranost, Centar trebao sam po službenoj dužnosti podnijeti zahtjev Centru za socijalnu skrb da se djetetu promijeni posebni skrbnik.

Zanimljivo je kako se tijekom nadzora pokazalo da je u propustima sudjelovalo i samo Ministarstvo koje sad vodi ministar Josip Aladrović jer su zahtjev za izvanrednim nadzorom nad radom obaju Centara koji je podnijela Severina Vučković tretirali kao prigovor.

U odnosu na posebnu skrbnicu protiv koje je pjevačica podnijela kaznenu prijavu i koja je na kraju razriješena odlukom Upravnog suda, prema našim informacijama u izvanrednom nadzoru je utvrđeno kako se na sudskom ročištu u studenome 2019. godine priklonila prijedlogu Centra za socijalnu skrb Maksimir da dijete živi s ocem jer majka ne surađuje s institucijama.

Kao zanimljiv detalj upućeni u rezultate nadzora navode podatak da je u lipnju 2020. sutkinja koja je odlučivala o skrbništvu u nazočnosti posebne skrbnice razgovarala s djetetom, da je ono reklo kako želi živjeti s majkom i da sve bude kao i prije, ali je zaključeno da izražavanje i ponašanje djeteta ne odaju sliku njegove autentične želje. O razgovoru je sastavljena zabilješka, ali nije potpisana.

U odnosu na slučaj Severine Vučković, odnosno njezina djeteta, nadzor je prema našim informacijama utvrdio da spis nije vođen po pravilima Uredbe o uredskom poslovanju, da se akti spisa nalaze izvan spisa predmeta, neki u drugim predmetima koji su izuzeti na daljnju obradu, da akti nisu urudžbirani kronološkim redom, da nisu upisani u košuljicu, da nije bilo moguće utvrditi koji akti su sastavni dio spisa, koja je kronologija postupanja te još niz nepravilnosti.

Nakon što je izvanredni upravni nadzor Ministarstva rada, mirovinskog sustava, obitelji i socijalne politike utvrdio više nepravilnosti u radu Centra za socijalnu skrb podružnice Maksimir, pjevačica Severina Vučković, koja je tvrdila da su institucije nezakonito postupale u njezinoj borbi za skrbništvo nad sinom, dobila je svojevrsnu satisfakciju.

No još je više nepravilnosti utvrđeno u radu Centra za posebno skrbništvo na koji je pjevačica također ukazivala, njih čak 24, piše Jutarnji list.
