Europske zemlje ne čine dovoljno da bi se rast globalnih temperatura, prema Pariškom sporazumu, do kraja stoljeća zadržao na 1,5 Celzijevih stupnjeva. Zbog toga trpe i okoliš i ljudi, osobito mladi, koji će najviše osjetiti posljedice toga nečinjenja.

Suština je to tužbe koju je prije tri godine, 2020., pred Europskim sudom za ljudska prava – međunarodnim sudom Vijeća Europe koji tumači Europsku konvenciju o ljudskim pravima – podignulo šestero mladih Portugalaca u dobi od 11 do 24 godine.

Njihova tužba nije prva takva po vrsti - baš je nedavno pred istim sudom održano saslušanje u vezi s “klimatskom tužbom” grupe švicarskih umirovljenica - ali po broju tuženih zemalja najveća je ikad: radi se o ukupno 32 europske zemlje, među kojima je i Hrvatska.

“Ovaj slučaj je bez presedana po svojim razmjerima i posljedicama. Nikad prije se toliko zemalja nije moralo braniti pred bilo kojim sudom bilo gdje u svijetu”, rekao je za Guardian Gearóid Ó Cuinn, iz Globalne mreže za pravnu akciju (GLAN), koja podržava tužitelje.
Slučaj "Duarte Agostinho i drugi protiv Portugala i 31 druge države" naći će se 27. rujna na prvom ročištu, i to pred 17 sudaca Velikog vijeća.

U tužbi šestero mladih navodi da su im tuženici prekršili ljudska prava time što nisu poduzeli dovoljno radnji u vezi s klimatskim promjenama te traže obvezujuću presudu kako bi se tužene države prisililo na brzo djelovanje i smanjenje svojih emisija stakleničkih plinova; takva presuda bila bi povijesna prekretnica u klimatskim parnicama.

Pozivaju se pritom na članke 2., 8. i 14. Europske konvencije o ljudskim pravima koji štite pravo na život, pravo na privatnost i pravo na nediskriminaciju. Podnositelji pritužbe tvrde da je njihovo pravo na život ugroženo učincima klimatskih promjena u Portugalu kao što su šumski požari, da njihovo pravo na privatnost uključuje njihovu fizičku i psihičku dobrobit, koja je ugrožena toplinskim valovima koji ih tjeraju da više vremena provode u zatvorenom prostoru, i da će, kao mladi ljudi, iskusiti najgore učinke klimatskih promjena.

Slučaj je pokrenut protiv država članica EU-a (Austrija, Belgija, Bugarska, Cipar, Češka, Njemačka, Grčka, Danska, Estonija, Finska, Francuska, Hrvatska, Mađarska, Irska, Italija, Litva, Luksemburg, Latvija, Malta, Nizozemska, Poljska, Portugal, Rumunjska, Slovačka, Slovenija, Španjolska i Švedska), kao i Norveške, Rusije, Švicarske, Turske i Ujedinjenog Kraljevstva.

Banaliziranje problema

Jedan od tužitelja, koji je u vrijeme podnošenja tužbe imao 11 godina, André Oliveira (15), rekao je za Guardian kako “živimo suočeni s klimatskim utjecajima diljem Europe. Kako se ne bismo bojali? Strah je sasvim normalan odgovor na ono čemu svjedočimo, kao i na neuspjeh vlada da djeluju i da nas zaštite. U Portugalu smo ovog ljeta iskusili toplinske valove koji su sve gori i gori”.

Odvjetnici će pred Velikim vijećem predstaviti dokaze da trenutna politika 32 zemlje znači da je svijet na putu da dosegne katastrofalnih 3°C globalnog zagrijavanja tijekom života mladih ljudi.

“Ovog srpnja temperature u Leiriji dosegnule su više od 40°C”, kaže tužiteljica Catarina Mota (23). “Naši stručnjaci kažu da će na 3°C biti još ekstremnijih toplinskih valova koji će trajati mjesec dana ili više. Vlade diljem svijeta imaju moć to zaustaviti. Europske vlade odlučuju ne sudjelovati u tome. Ne možemo stajati sa strane i gledati kako se ovo događa.”

U dokumentima predanim sudu države odbacuju te tvrdnje, poričući u mnogim slučajevima da su klimatske promjene uopće prijetnja dobrobiti ljudi.

Grčka vlada, na primjer, koja se ovog ljeta borila s razornim utjecajem stotina smrtonosnih šumskih požara, kao i poplava, izjavila je kako se ne može uspostaviti apsolutna uzročno-posljedična veza između klimatskih promjena i utjecaja na ljudsko zdravlje. I irska vlada odbacila je argument tužitelja, rekavši da nisu utvrdili neposrednu opasnost za svoje živote. Matična zemlja grupe tužitelja, Portugal, brani se kako se tužba sastoji samo od budućih strahova, koji predstavljaju samo “puke pretpostavke ili opće vjerojatnosti”.

“Ovi mladi ljudi suočavaju se s budućnošću nepodnošljivih vrućina; posljednje izvješće IPCC-a opisuje te uvjete kao nepogodne za život”, rekao je Gerry Liston, odvjetnik u GLAN-u. “Pa ipak, ove vlade trivijaliziraju svoje tvrdnje, a očekujemo da ćemo još toga u sudnici čuti od svih tuženih.”

Dodaje kako je slučaj zapravo vrlo jednostavan – šteta koju klimatske promjene uzrokuju, i nastavit će uzrokovati, mentalnom i fizičkom zdravlju ovih mladih ljudi i njihovoj dobrobiti očito je kršenje njihovih ljudskih prava. Tužitelje - koji su se za ovo počeli pripremati još 2017. godine i koji napominju da se “ne radi samo o njima, nego o cijelom društvu” - financijski podupiru ljudi sa svih strana svijeta donacijama čija je vrijednost prešla 100.000 eura.

O tome što u hrvatskoj Vladi misle i rade u vezi s ovim slučajem, u javnosti se dosad nije čulo. Nacional donosi kako “Plenkovićeva vlada očito ne shvaća ozbiljno tužbu šestero mladih Portugalaca”. Na njihove upite, naime, upućene ministarstvima vanjskih poslova i gospodarstva i održivog razvoja, te Uredu zastupnice RH pred ESLJP-om (do zaključenja broja) nisu dobili odgovore.

Europske zemlje ne čine dovoljno da bi se rast globalnih temperatura, prema Pariškom sporazumu, do kraja stoljeća zadržao na 1,5 Celzijevih stupnjeva. Zbog toga trpe i okoliš i ljudi, osobito mladi, koji će najviše osjetiti posljedice toga nečinjenja.

Suština je to tužbe koju je prije tri godine, 2020., pred Europskim sudom za ljudska prava – međunarodnim sudom Vijeća Europe koji tumači Europsku konvenciju o ljudskim pravima – podignulo šestero mladih Portugalaca u dobi od 11 do 24 godine.

Njihova tužba nije prva takva po vrsti - baš je nedavno pred istim sudom održano saslušanje u vezi s “klimatskom tužbom” grupe švicarskih umirovljenica - ali po broju tuženih zemalja najveća je ikad: radi se o ukupno 32 europske zemlje, među kojima je i Hrvatska.

“Ovaj slučaj je bez presedana po svojim razmjerima i posljedicama. Nikad prije se toliko zemalja nije moralo braniti pred bilo kojim sudom bilo gdje u svijetu”, rekao je za Guardian Gearóid Ó Cuinn, iz Globalne mreže za pravnu akciju (GLAN), koja podržava tužitelje.
Slučaj "Duarte Agostinho i drugi protiv Portugala i 31 druge države" naći će se 27. rujna na prvom ročištu, i to pred 17 sudaca Velikog vijeća.

U tužbi šestero mladih navodi da su im tuženici prekršili ljudska prava time što nisu poduzeli dovoljno radnji u vezi s klimatskim promjenama te traže obvezujuću presudu kako bi se tužene države prisililo na brzo djelovanje i smanjenje svojih emisija stakleničkih plinova; takva presuda bila bi povijesna prekretnica u klimatskim parnicama.

Pozivaju se pritom na članke 2., 8. i 14. Europske konvencije o ljudskim pravima koji štite pravo na život, pravo na privatnost i pravo na nediskriminaciju. Podnositelji pritužbe tvrde da je njihovo pravo na život ugroženo učincima klimatskih promjena u Portugalu kao što su šumski požari, da njihovo pravo na privatnost uključuje njihovu fizičku i psihičku dobrobit, koja je ugrožena toplinskim valovima koji ih tjeraju da više vremena provode u zatvorenom prostoru, i da će, kao mladi ljudi, iskusiti najgore učinke klimatskih promjena.

Slučaj je pokrenut protiv država članica EU-a (Austrija, Belgija, Bugarska, Cipar, Češka, Njemačka, Grčka, Danska, Estonija, Finska, Francuska, Hrvatska, Mađarska, Irska, Italija, Litva, Luksemburg, Latvija, Malta, Nizozemska, Poljska, Portugal, Rumunjska, Slovačka, Slovenija, Španjolska i Švedska), kao i Norveške, Rusije, Švicarske, Turske i Ujedinjenog Kraljevstva.

Banaliziranje problema

Jedan od tužitelja, koji je u vrijeme podnošenja tužbe imao 11 godina, André Oliveira (15), rekao je za Guardian kako “živimo suočeni s klimatskim utjecajima diljem Europe. Kako se ne bismo bojali? Strah je sasvim normalan odgovor na ono čemu svjedočimo, kao i na neuspjeh vlada da djeluju i da nas zaštite. U Portugalu smo ovog ljeta iskusili toplinske valove koji su sve gori i gori”.

Odvjetnici će pred Velikim vijećem predstaviti dokaze da trenutna politika 32 zemlje znači da je svijet na putu da dosegne katastrofalnih 3°C globalnog zagrijavanja tijekom života mladih ljudi.

“Ovog srpnja temperature u Leiriji dosegnule su više od 40°C”, kaže tužiteljica Catarina Mota (23). “Naši stručnjaci kažu da će na 3°C biti još ekstremnijih toplinskih valova koji će trajati mjesec dana ili više. Vlade diljem svijeta imaju moć to zaustaviti. Europske vlade odlučuju ne sudjelovati u tome. Ne možemo stajati sa strane i gledati kako se ovo događa.”

U dokumentima predanim sudu države odbacuju te tvrdnje, poričući u mnogim slučajevima da su klimatske promjene uopće prijetnja dobrobiti ljudi.

Grčka vlada, na primjer, koja se ovog ljeta borila s razornim utjecajem stotina smrtonosnih šumskih požara, kao i poplava, izjavila je kako se ne može uspostaviti apsolutna uzročno-posljedična veza između klimatskih promjena i utjecaja na ljudsko zdravlje. I irska vlada odbacila je argument tužitelja, rekavši da nisu utvrdili neposrednu opasnost za svoje živote. Matična zemlja grupe tužitelja, Portugal, brani se kako se tužba sastoji samo od budućih strahova, koji predstavljaju samo “puke pretpostavke ili opće vjerojatnosti”.

“Ovi mladi ljudi suočavaju se s budućnošću nepodnošljivih vrućina; posljednje izvješće IPCC-a opisuje te uvjete kao nepogodne za život”, rekao je Gerry Liston, odvjetnik u GLAN-u. “Pa ipak, ove vlade trivijaliziraju svoje tvrdnje, a očekujemo da ćemo još toga u sudnici čuti od svih tuženih.”

Dodaje kako je slučaj zapravo vrlo jednostavan – šteta koju klimatske promjene uzrokuju, i nastavit će uzrokovati, mentalnom i fizičkom zdravlju ovih mladih ljudi i njihovoj dobrobiti očito je kršenje njihovih ljudskih prava. Tužitelje - koji su se za ovo počeli pripremati još 2017. godine i koji napominju da se “ne radi samo o njima, nego o cijelom društvu” - financijski podupiru ljudi sa svih strana svijeta donacijama čija je vrijednost prešla 100.000 eura.

O tome što u hrvatskoj Vladi misle i rade u vezi s ovim slučajem, u javnosti se dosad nije čulo. Nacional donosi kako “Plenkovićeva vlada očito ne shvaća ozbiljno tužbu šestero mladih Portugalaca”. Na njihove upite, naime, upućene ministarstvima vanjskih poslova i gospodarstva i održivog razvoja, te Uredu zastupnice RH pred ESLJP-om (do zaključenja broja) nisu dobili odgovore.
