O problemu tretmana stranih radnika, pored brojnih već poznatih slučajeva, svjedoči i slučaj zagrebačke tvrtke Etera plus koju je zbog zapošljavanja stranih radnika na crno ovih dana zapečatio Državni inspektorat.

Riječ je o, kako Jutarnji list doznaje, tvrtki agregat koja zapošljava strane radnike za potrebe platformi za dostavu hrane, prvenstvano Glovo, a u kojoj je Inspektorat nadzore provodio tijekom ove i tijekom prošle godine, otkrivši da se tamo krše odredbe Zakona o strancima, ali i Zakona o obaveznom mirovinskom osiguranju.

Točnije, inspekcija je u tvrtki Etera plus otkrila kako zapošljavaju odnosno koriste rad državljanina treće zemlje koji nema dozvolu za boravak i rad ili potvrdu o prijavi rada, a zatim da su u dva navrata zakon prekršili jer radnika nisu prijavili na mirovinsko osiguranje.

Da je tome zaista tako uvjerili smo se na licu mjesta, u sjedištu tvrtke na zagrebačkoj Samoborskoj cesti 213, na kojoj je zalijepljena traka Državnog inspektorata te postavljena obavijest o privremenoj zabrani rada u trajanju od 30 dana.

Jutarnji je pak za ovaj slučaj informaciju dobio na temelju anonimnog maila kojeg potpisuju navodni radnici tvrtke, a u kojemu se navodi kako Etera plus radi za platformu GLOVO, da joj je nedavno rad zabranio Državni inspektorat, ali da oni ipak i dalje rade te radnike šalju na teren.

U mailu također upozoravaju na brojne druge probleme - da jako kasne s isplatom plaća ili ih uopće ne isplaćuju, da imaju užasan smještaj za radnike kao i da imaju daleko veći broj radnika nego što to službeno navode.

Mi smo osobe koje stoje iza maila zamolile da nam omoguće telefonski kontakt te da uživo porazgovaramo o ovim optužbama, ali oni su to odbili, navodno iz straha, pa smo njiihove navode o pečačenju prostorije provjerili kod Državnog inspektorata koji nam je dobar dio optužbi potvrdio.

"Osim poduzimanja prekršajnih mjera odnosno pokretanja prekršajnih postupaka, inspektor rada je u skladu s odredbama članka 240. stavka 1. Zakona o strancima u jednom od inspekcijskih nadzora u kojem je utvrđen nezakoniti rad državljana trećih zemalja bez dozvole za boravak i rad poslodavcu usmenim rješenjem u zapisniku privremeno zabranio obavljanje djelatnosti u trajanju od 30 dana. Napominjemo da je u tijeku obavljanje novog inspekcijskog nadzora kod navedenog poslodavca te da, s obzirom da inspekcijski nadzor nije okončan, isti nismo u mogućnosti komentirati"m, kazali su iz Inspektorata te dodali kako su prekršajni nalog izdali i jednom državljaninu trećih zemalja, zbog počinjenog prekršaja iz članka 88. stavka 1. Zakona o strancima, kažnjivog po članku 250. stavku 1. istog Zakona odnosno jer je navedene poslove obavljao bez dozvole za boravak i rad ili potvrde o prijavi rada, na što je izjavljen prigovor.

Inače, prema podacima iz Trgovačkog registra, tvrtka Etera plus d.o.o prvenstveno je registrirana za ostali kopneni prijevoz putnika, i to 2022. godine, a osnivači su joj Tomislav Štefanac i Amir Alešević.

Prema podacima s portala Info BIZ, tvrtka je lani ostvarila 96 tisuća eura prihoda, imala tek petero zaposlenih te islaćivala plaću od 356 eura po radniku na mjesec.

Nema zabilježenu blokadu, ali stoji napomena kako je riječ o tvrtki s povišenom vjerojatnošću zastoja u plaćanju.

Jutarnji list kontaktirao je vlasnika tvrtke Tomislava Štefanca kako bi nam objasnio zašto je došlo u problemu sposlovanjem, no on nas je zamolio da pošaljemo mail pa ćemo njegove odgovore uvrstiti u tekst kad ih dobijemo.

O problemu tretmana stranih radnika, pored brojnih već poznatih slučajeva, svjedoči i slučaj zagrebačke tvrtke Etera plus koju je zbog zapošljavanja stranih radnika na crno ovih dana zapečatio Državni inspektorat.

Riječ je o, kako Jutarnji list doznaje, tvrtki agregat koja zapošljava strane radnike za potrebe platformi za dostavu hrane, prvenstvano Glovo, a u kojoj je Inspektorat nadzore provodio tijekom ove i tijekom prošle godine, otkrivši da se tamo krše odredbe Zakona o strancima, ali i Zakona o obaveznom mirovinskom osiguranju.

Točnije, inspekcija je u tvrtki Etera plus otkrila kako zapošljavaju odnosno koriste rad državljanina treće zemlje koji nema dozvolu za boravak i rad ili potvrdu o prijavi rada, a zatim da su u dva navrata zakon prekršili jer radnika nisu prijavili na mirovinsko osiguranje.

Da je tome zaista tako uvjerili smo se na licu mjesta, u sjedištu tvrtke na zagrebačkoj Samoborskoj cesti 213, na kojoj je zalijepljena traka Državnog inspektorata te postavljena obavijest o privremenoj zabrani rada u trajanju od 30 dana.

Jutarnji je pak za ovaj slučaj informaciju dobio na temelju anonimnog maila kojeg potpisuju navodni radnici tvrtke, a u kojemu se navodi kako Etera plus radi za platformu GLOVO, da joj je nedavno rad zabranio Državni inspektorat, ali da oni ipak i dalje rade te radnike šalju na teren.

U mailu također upozoravaju na brojne druge probleme - da jako kasne s isplatom plaća ili ih uopće ne isplaćuju, da imaju užasan smještaj za radnike kao i da imaju daleko veći broj radnika nego što to službeno navode.

Mi smo osobe koje stoje iza maila zamolile da nam omoguće telefonski kontakt te da uživo porazgovaramo o ovim optužbama, ali oni su to odbili, navodno iz straha, pa smo njiihove navode o pečačenju prostorije provjerili kod Državnog inspektorata koji nam je dobar dio optužbi potvrdio.

"Osim poduzimanja prekršajnih mjera odnosno pokretanja prekršajnih postupaka, inspektor rada je u skladu s odredbama članka 240. stavka 1. Zakona o strancima u jednom od inspekcijskih nadzora u kojem je utvrđen nezakoniti rad državljana trećih zemalja bez dozvole za boravak i rad poslodavcu usmenim rješenjem u zapisniku privremeno zabranio obavljanje djelatnosti u trajanju od 30 dana. Napominjemo da je u tijeku obavljanje novog inspekcijskog nadzora kod navedenog poslodavca te da, s obzirom da inspekcijski nadzor nije okončan, isti nismo u mogućnosti komentirati"m, kazali su iz Inspektorata te dodali kako su prekršajni nalog izdali i jednom državljaninu trećih zemalja, zbog počinjenog prekršaja iz članka 88. stavka 1. Zakona o strancima, kažnjivog po članku 250. stavku 1. istog Zakona odnosno jer je navedene poslove obavljao bez dozvole za boravak i rad ili potvrde o prijavi rada, na što je izjavljen prigovor.

Inače, prema podacima iz Trgovačkog registra, tvrtka Etera plus d.o.o prvenstveno je registrirana za ostali kopneni prijevoz putnika, i to 2022. godine, a osnivači su joj Tomislav Štefanac i Amir Alešević.

Prema podacima s portala Info BIZ, tvrtka je lani ostvarila 96 tisuća eura prihoda, imala tek petero zaposlenih te islaćivala plaću od 356 eura po radniku na mjesec.

Nema zabilježenu blokadu, ali stoji napomena kako je riječ o tvrtki s povišenom vjerojatnošću zastoja u plaćanju.

Jutarnji list kontaktirao je vlasnika tvrtke Tomislava Štefanca kako bi nam objasnio zašto je došlo u problemu sposlovanjem, no on nas je zamolio da pošaljemo mail pa ćemo njegove odgovore uvrstiti u tekst kad ih dobijemo.
