Sutkinja Općinskog suda Brankica Grgurić izrekla je odbijajuću presudu protiv dr. Branka Popovića protiv kojeg se vodio višegodišnji kazneni postupak za teško kazneno djelo protiv zdravlja ljudi zbog nesavjesnog liječenja iz nehaja u slučaju pacijenta Miroslava Maškarina s Raba. Kako je kratko obrazložila sutkinja, optužba je odbijena zbog nastupa zastare, piše Novi list.
Mašakarin, koji je 2006. imao 21 godinu, podvrgnut je rutinskoj operaciji slijepog crijeva u KBC-u Rijeka koja je završila amputacijom lijeve potkoljenice.
Dr. Popović je bio optužen da je iz nehaja kao doktor medicine obavljajući svoju djelatnost nesavjesno postupao i time prouzročio teške tjelesne ozljede Miroslavu Maškarinu. Kazneni postupak obustavljen je zbog zastare koja je nastupila još 2014. godine.
Kirurg Branko Popović je nepravomoćno sredinom rujna 2011. godine bio osuđen i proglašen krivim te je osuđen na kaznu zatvora od osam mjeseci, uvjetno na dvije godine. Rješenjem Županijskog suda potkraj listopada 2012. godine prvostupanjska presuda je ukinuta i slučaj je vraćen sudu na ponovno suđenje. No, 1. siječnja 2013. godine na snagu je stupio novi Kazneni zakon, a 21. svibnja 2013. počelo je ponovno suđenje dr. Popoviću.
Naime, dr. Popović je bio optužen za kazneno djelo nesavjesnog liječenja iz nehaja i tada je za to djelo bila predviđena kazna zatvora od šest mjeseci do pet godina. Izmjenom Kaznenog zakona, za to djelo je predviđena kazna zatvora do jedne godine.
Općinsko državno odvjetništvo tvrdilo je da pravni kontinuitet stoji u činjenici da je oštećeni Maškarin izgubio nogu pa samim time i da je riječ o osobito teškoj tjelesnoj ozljedi. Međutim, upitan za komentar još prošle godine, Škrlec je rekao da doktor Popović nije optužen za osobito tešku tjelesnu ozljedu niti za gubitak noge, niti je išta ukazivalo na direktnu vezu rupture aorte i gubitka noge. No, neovisno o tomu, po kaznenom zakonu koji je bio na snazi 2006. godine, nije ni postojalo djelo, a niti odgovornost za osobito tešku tjelesnu ozljedu kao posljedicu, pa onda dr. Popović ne može ni odgovarati za tu posljedicu, sve i da postoji, piše Novi list.

Sutkinja Općinskog suda Brankica Grgurić izrekla je odbijajuću presudu protiv dr. Branka Popovića protiv kojeg se vodio višegodišnji kazneni postupak za teško kazneno djelo protiv zdravlja ljudi zbog nesavjesnog liječenja iz nehaja u slučaju pacijenta Miroslava Maškarina s Raba. Kako je kratko obrazložila sutkinja, optužba je odbijena zbog nastupa zastare, piše Novi list.
Mašakarin, koji je 2006. imao 21 godinu, podvrgnut je rutinskoj operaciji slijepog crijeva u KBC-u Rijeka koja je završila amputacijom lijeve potkoljenice.
Dr. Popović je bio optužen da je iz nehaja kao doktor medicine obavljajući svoju djelatnost nesavjesno postupao i time prouzročio teške tjelesne ozljede Miroslavu Maškarinu. Kazneni postupak obustavljen je zbog zastare koja je nastupila još 2014. godine.
Kirurg Branko Popović je nepravomoćno sredinom rujna 2011. godine bio osuđen i proglašen krivim te je osuđen na kaznu zatvora od osam mjeseci, uvjetno na dvije godine. Rješenjem Županijskog suda potkraj listopada 2012. godine prvostupanjska presuda je ukinuta i slučaj je vraćen sudu na ponovno suđenje. No, 1. siječnja 2013. godine na snagu je stupio novi Kazneni zakon, a 21. svibnja 2013. počelo je ponovno suđenje dr. Popoviću.
Naime, dr. Popović je bio optužen za kazneno djelo nesavjesnog liječenja iz nehaja i tada je za to djelo bila predviđena kazna zatvora od šest mjeseci do pet godina. Izmjenom Kaznenog zakona, za to djelo je predviđena kazna zatvora do jedne godine.
Općinsko državno odvjetništvo tvrdilo je da pravni kontinuitet stoji u činjenici da je oštećeni Maškarin izgubio nogu pa samim time i da je riječ o osobito teškoj tjelesnoj ozljedi. Međutim, upitan za komentar još prošle godine, Škrlec je rekao da doktor Popović nije optužen za osobito tešku tjelesnu ozljedu niti za gubitak noge, niti je išta ukazivalo na direktnu vezu rupture aorte i gubitka noge. No, neovisno o tomu, po kaznenom zakonu koji je bio na snazi 2006. godine, nije ni postojalo djelo, a niti odgovornost za osobito tešku tjelesnu ozljedu kao posljedicu, pa onda dr. Popović ne može ni odgovarati za tu posljedicu, sve i da postoji, piše Novi list.
