Cijelo jutro i dobar dio radnog dana u utorak trajalo je na splitskom Županijskom sudu, nogometnim riječnikom rečeno, "taktičko nadmudrivanje" između sutkinje Ivone Rupić, predsjednice sudskog vijeća te okrivljenih Stjepana Ringwalda, Jerka Pirića i Vlade Zolote uz pravnu potporu njihovih odvjetnika Borisa Majića, Doris Košta i Borisa Miloševića.

Podsjetimo, trojici je u tijeku suđenje zbog optužbi da su zajednički i dogovorno isplanirali i realizirali ubojstvo Karmelina Fistanića (39) početkom studenoga 2019. godine na Jadranskoj magistrali na ulazu u Omiš kod skretanja za Brzet.

Dakle, cilj ovog nadmudrivanja je tko će i na koji način dočekati 12. prosinca ove godine kada okrivljenicima po sili zakona prestaje važiti istražni zatvor u kojem su proveli gotovo dvije godine te će, ako do tad ne bude donesena nepravomoćna presuda, morati biti pušteni da se brane sa slobode. Naravno, sudskom vijeću je u interesu da do tada izrekne presudu iako to, očito, neće biti nimalo lako.

Sutkinja Rupić je jučer nekoliko puta neuspješno pokušavala od Ringwalda uzeti obranu. Prvo je on odmah na početku rasprave kazao da traži izuzeće zamjenice ŽDO-a Rene Laura koja vodi predmet, njenog nadređenog Michelea Squiccimarra, njegove zamjenice i svih zamjenica u Splitu, a potom i glavne državne odvjetnice Zlate Šipek i svih njenih zamjenika. Gotovo sat vremena je Ringwald obrazlagao zašto to traži, a uz ostalo je naveo da mu nije odgovoreno na niti jednu od njegovih prijava koju je podnio zbog sumnji u prikrivanje i podmetanje dokaza među kojima su i fotografija žrtve na kojoj se vidi da mu je pucano u čelo koja je poslije "isparila" iz predmeta. Također je rekao i da je sve ovo plod crne mašte jednog omiškog policajca koji se ustvari, kazao je Ringwald, prije drugačije zvao i bio je njegov školski kolega, a umiješan je u ratni zločin u Škabrnji o čemu ima i dokaze na VHS kazeti i svjedoke. Baš zato jer ga je Ringwald prepoznao u jednoj konobi nakon 30 godina, ovaj mu je policajac, kazao je, namjestio cijelu priču oko ubojstva, a sudjelovao je i u podmetanju krvi na jaknu u njegovom stanu u Šibeniku.

- Sve je počelo jer sam prepoznao tog čovjeka. Pa čak su policajci PP Omiš nakon što su podmetnuli krv na jaknu nazvali svog šefa i rekli mu da su obavili zadatak. Moja je slika u toj jakni objavljena u novinama 20-ak dana nakon ubojstva, to je bilo 15-ak dana prije privođenja. Pa ja sam ubija čovika i onda se dva miseca krvav šeta po gradu, jel? - pitao je Ringwald.

Njegovi su zahtjevi, nakon 40-ak minuta pauze, naravno odbijeni. Onda je uslijedio zahtjev odvjetnice Košte da se kao dokaz pregledaju snimke videonadzora koje su na hard disku ili da se to izdvoji iz spisa. Obrane smatraju da su video isječci koji su pregledani, a nalaze se na DVD-u "montirani i složeni" kako to odgovara optužbi. Ostali su se složili s tim. Uslijedila je nova pauza i opet odbijanje prijedloga uz obrazloženje da su usmjereni na odugovlačenje postupka i da sud ima dužnost takve radnje spriječiti.

Zatim odvjetnica Košta podnosi zahtjev za izuzeće sutkinje Rupić, njenog vijeća, predsjednika Županijskog suda, svih sudaca te predsjednika Visokog kaznenog suda i njegove zamjenice. Ustvrdila je da je pristrana i neobjektivna i da je obrana tijekom cijelog postupka bila "osakaćena" jer se nije uzeo u obzir niti jedan od 50 predloženih dokaza koji njima idu u korist. Nakon polusatne pauze je sutkinja Rupić i to odbila, a onda je Ringwald osobno zatražio njeno izuzeće. I opet je određena pauza, a nakon čega je i taj prijedlog odbijen. No, nije tu bio kraj.

Tada Zolota otkazuje punomoć svom odvjetniku Miloševiću kazavši da je ovaj indisponiran, da nije upoznat sa spisom i da je nezadovoljan njegovim radom. U ovom slučaju sud mora dati rok okrivljenom da angažira novog odvjetnika koji se mora upoznati s predmetom, a to zahtjeva neko vrijeme. Zato je sutkinja "doskočila" tako što je po službenoj dužnosti opet imenovala Miloševića koji se nalazi na spisku branitelja. To se Zoloti nije svidjelo, no sutkinja mu nije ostavila prostora za manevar. Nastavak je u četvrtak.

Cijelo jutro i dobar dio radnog dana u utorak trajalo je na splitskom Županijskom sudu, nogometnim riječnikom rečeno, "taktičko nadmudrivanje" između sutkinje Ivone Rupić, predsjednice sudskog vijeća te okrivljenih Stjepana Ringwalda, Jerka Pirića i Vlade Zolote uz pravnu potporu njihovih odvjetnika Borisa Majića, Doris Košta i Borisa Miloševića.

Podsjetimo, trojici je u tijeku suđenje zbog optužbi da su zajednički i dogovorno isplanirali i realizirali ubojstvo Karmelina Fistanića (39) početkom studenoga 2019. godine na Jadranskoj magistrali na ulazu u Omiš kod skretanja za Brzet.

Dakle, cilj ovog nadmudrivanja je tko će i na koji način dočekati 12. prosinca ove godine kada okrivljenicima po sili zakona prestaje važiti istražni zatvor u kojem su proveli gotovo dvije godine te će, ako do tad ne bude donesena nepravomoćna presuda, morati biti pušteni da se brane sa slobode. Naravno, sudskom vijeću je u interesu da do tada izrekne presudu iako to, očito, neće biti nimalo lako.

Sutkinja Rupić je jučer nekoliko puta neuspješno pokušavala od Ringwalda uzeti obranu. Prvo je on odmah na početku rasprave kazao da traži izuzeće zamjenice ŽDO-a Rene Laura koja vodi predmet, njenog nadređenog Michelea Squiccimarra, njegove zamjenice i svih zamjenica u Splitu, a potom i glavne državne odvjetnice Zlate Šipek i svih njenih zamjenika. Gotovo sat vremena je Ringwald obrazlagao zašto to traži, a uz ostalo je naveo da mu nije odgovoreno na niti jednu od njegovih prijava koju je podnio zbog sumnji u prikrivanje i podmetanje dokaza među kojima su i fotografija žrtve na kojoj se vidi da mu je pucano u čelo koja je poslije "isparila" iz predmeta. Također je rekao i da je sve ovo plod crne mašte jednog omiškog policajca koji se ustvari, kazao je Ringwald, prije drugačije zvao i bio je njegov školski kolega, a umiješan je u ratni zločin u Škabrnji o čemu ima i dokaze na VHS kazeti i svjedoke. Baš zato jer ga je Ringwald prepoznao u jednoj konobi nakon 30 godina, ovaj mu je policajac, kazao je, namjestio cijelu priču oko ubojstva, a sudjelovao je i u podmetanju krvi na jaknu u njegovom stanu u Šibeniku.

- Sve je počelo jer sam prepoznao tog čovjeka. Pa čak su policajci PP Omiš nakon što su podmetnuli krv na jaknu nazvali svog šefa i rekli mu da su obavili zadatak. Moja je slika u toj jakni objavljena u novinama 20-ak dana nakon ubojstva, to je bilo 15-ak dana prije privođenja. Pa ja sam ubija čovika i onda se dva miseca krvav šeta po gradu, jel? - pitao je Ringwald.

Njegovi su zahtjevi, nakon 40-ak minuta pauze, naravno odbijeni. Onda je uslijedio zahtjev odvjetnice Košte da se kao dokaz pregledaju snimke videonadzora koje su na hard disku ili da se to izdvoji iz spisa. Obrane smatraju da su video isječci koji su pregledani, a nalaze se na DVD-u "montirani i složeni" kako to odgovara optužbi. Ostali su se složili s tim. Uslijedila je nova pauza i opet odbijanje prijedloga uz obrazloženje da su usmjereni na odugovlačenje postupka i da sud ima dužnost takve radnje spriječiti.

Zatim odvjetnica Košta podnosi zahtjev za izuzeće sutkinje Rupić, njenog vijeća, predsjednika Županijskog suda, svih sudaca te predsjednika Visokog kaznenog suda i njegove zamjenice. Ustvrdila je da je pristrana i neobjektivna i da je obrana tijekom cijelog postupka bila "osakaćena" jer se nije uzeo u obzir niti jedan od 50 predloženih dokaza koji njima idu u korist. Nakon polusatne pauze je sutkinja Rupić i to odbila, a onda je Ringwald osobno zatražio njeno izuzeće. I opet je određena pauza, a nakon čega je i taj prijedlog odbijen. No, nije tu bio kraj.

Tada Zolota otkazuje punomoć svom odvjetniku Miloševiću kazavši da je ovaj indisponiran, da nije upoznat sa spisom i da je nezadovoljan njegovim radom. U ovom slučaju sud mora dati rok okrivljenom da angažira novog odvjetnika koji se mora upoznati s predmetom, a to zahtjeva neko vrijeme. Zato je sutkinja "doskočila" tako što je po službenoj dužnosti opet imenovala Miloševića koji se nalazi na spisku branitelja. To se Zoloti nije svidjelo, no sutkinja mu nije ostavila prostora za manevar. Nastavak je u četvrtak.
