U travnju prošle godine pisali smo o slučaju bivše direktorice “Plovputa” Silvane T. koja je na splitskom Općinskom sudu, nakon sedam godina sudovanja, u samo 45 minuta suđenja nepravomoćno oslobođena odgovornosti za sklapanje štetnog ugovora. No, predmet je po žalbi ODO-a Split otišao na Županijski sud u Osijek čije vijeće, pak, nije bilo istog stava kao i splitski sudac Velimir Kovačević koji je donio prvostupanjsku presudu.
Tako su njegovu presudu, uvažavajući žalbu ODO-a, ukinuli i predmet vratili na ponovno suđenje. Podsjetimo, optužnica iz rujna 2012. godine teretila je nekadašnju direktoricu ove državne tvrtke da je u rujnu 2007. godine, kad je već bila svjesna da će biti smijenjena s te funkcije, na mjesto rukovoditelja pravno-kadrovskog sektora zaposlila muškarca koji nije završio Pravni fakultet i nije imao položen pravosudni ispit, odnosno nije imao potrebne referencije za taj posao.
Četiri od 50 dokaza
S tom je osobom sklopila ugovor o radu na pet godina uz plaću od tri i pol bruto plaće, znajući, po optužnici, da će tvrtka nakon njezine smjene raskinuti taj ugovor. To se naravno i dogodilo, a muškarac je tužio tvrtku i pravomoćnom presudom dobio da mu “Plovput” mora isplatiti više od milijun i 600 tisuća kuna razlike plaće. Postupak je trajao sedam godina, nizale su se rasprave i vještačenja, a onda je predmet dobio navedeni sudac i u jednom ročištu riješio problem.
Odbio je sve predložene dokaze tužiteljstva, njih čak 50, uz obrazloženje “da se izvođenje tih dokaza čini nevažnim jer se iz njih ne bi moglo utvrditi da je okrivljena počinila kazneno djelo”. Prihvatio je i na raspravi izveo samo četiri, od čega su tri uvid u dokumentaciju te je ispitao okrivljenu.
Sudac je u svojoj oslobađajućoj odluci naveo i da je okrivljena sklopila ugovor s N.B. kao zaposlenikom te da se ugovor odnosi na unutarnju organizaciju pravnih poslova, pa zato ona tim sklapanjem nije obavljala gospodarsku djelatnost te time nema ni bitnog obilježja djela niti je prouzročena šteta.
Osječki sud ističe u svojoj odluci da je sudac prvo naveo da nema dokaza da je optužena počinila kazneno djelo da bi onda napisao da djelo koje je počinila nije kazneno djelo.
- Sud će u ponovljenom postupku posebice pozornije ocijeniti materijalne dokaze u spisu, nalaze i mišljenja financijsko-knjigovodstvenih vještaka čiji zaključci nisu suglasni u odlučnim činjenicama. Potom će donijeti pravilnu i zakonitu odluku uz navođenje jasnih i potpunih razloga, i o činjenicama i o pravnim pitanjima - navodi se, među ostalim, u ukidajućoj odluci Županijskog suda u Osijeku.

U travnju prošle godine pisali smo o slučaju bivše direktorice “Plovputa” Silvane T. koja je na splitskom Općinskom sudu, nakon sedam godina sudovanja, u samo 45 minuta suđenja nepravomoćno oslobođena odgovornosti za sklapanje štetnog ugovora. No, predmet je po žalbi ODO-a Split otišao na Županijski sud u Osijek čije vijeće, pak, nije bilo istog stava kao i splitski sudac Velimir Kovačević koji je donio prvostupanjsku presudu.
Tako su njegovu presudu, uvažavajući žalbu ODO-a, ukinuli i predmet vratili na ponovno suđenje. Podsjetimo, optužnica iz rujna 2012. godine teretila je nekadašnju direktoricu ove državne tvrtke da je u rujnu 2007. godine, kad je već bila svjesna da će biti smijenjena s te funkcije, na mjesto rukovoditelja pravno-kadrovskog sektora zaposlila muškarca koji nije završio Pravni fakultet i nije imao položen pravosudni ispit, odnosno nije imao potrebne referencije za taj posao.
Četiri od 50 dokaza
S tom je osobom sklopila ugovor o radu na pet godina uz plaću od tri i pol bruto plaće, znajući, po optužnici, da će tvrtka nakon njezine smjene raskinuti taj ugovor. To se naravno i dogodilo, a muškarac je tužio tvrtku i pravomoćnom presudom dobio da mu “Plovput” mora isplatiti više od milijun i 600 tisuća kuna razlike plaće. Postupak je trajao sedam godina, nizale su se rasprave i vještačenja, a onda je predmet dobio navedeni sudac i u jednom ročištu riješio problem.
Odbio je sve predložene dokaze tužiteljstva, njih čak 50, uz obrazloženje “da se izvođenje tih dokaza čini nevažnim jer se iz njih ne bi moglo utvrditi da je okrivljena počinila kazneno djelo”. Prihvatio je i na raspravi izveo samo četiri, od čega su tri uvid u dokumentaciju te je ispitao okrivljenu.
Sudac je u svojoj oslobađajućoj odluci naveo i da je okrivljena sklopila ugovor s N.B. kao zaposlenikom te da se ugovor odnosi na unutarnju organizaciju pravnih poslova, pa zato ona tim sklapanjem nije obavljala gospodarsku djelatnost te time nema ni bitnog obilježja djela niti je prouzročena šteta.
Osječki sud ističe u svojoj odluci da je sudac prvo naveo da nema dokaza da je optužena počinila kazneno djelo da bi onda napisao da djelo koje je počinila nije kazneno djelo.
- Sud će u ponovljenom postupku posebice pozornije ocijeniti materijalne dokaze u spisu, nalaze i mišljenja financijsko-knjigovodstvenih vještaka čiji zaključci nisu suglasni u odlučnim činjenicama. Potom će donijeti pravilnu i zakonitu odluku uz navođenje jasnih i potpunih razloga, i o činjenicama i o pravnim pitanjima - navodi se, među ostalim, u ukidajućoj odluci Županijskog suda u Osijeku.
