Vodstvo Košarkaškog kluba Split možda će ipak morati sjesti za stol sa svojim nekadašnjim trenerom Mladenom Mikijem Starčevićem. Trebali bi se dogovoriti kako će mu, nakon 19 godina, platiti 97.000 eura za njegov rad ili 40 posto tog iznosa, koliki postotak su u predstečajnom postupku dobili ostali vjerovnici.
U suprotnom, klub s Gripa riskira - otvaranje stečaja.
Naime, Visoki trgovački sud ukinuo je rješenje Trgovačkog suda u Splitu o odbačaju prijedloga Mladena Starčevića za otvaranje stečaja nad Košarkaškim klubom Split.
Splitski sud stoga će ponovno morati odlučivati o trenerovu prijedlogu, ali ovaj put uz upute koje je dao viši sud.
Trgovački sud u Splitu je, naime, tvrdio da trener Starčević nije vjerovnik KK-a Split iz ovršene isprave, odnosno da nije naveden u predstečajnoj nagodbi između kluba i njegovih vjerovnika, te da zbog toga nije ovlašten podnositi prijedlog za otvaranje stečaja nad klubom.
No Visoki trgovački sud RH utvrdio je da je rješenje splitskog suda nepravilno i nezakonito jer je izreka presude – nerazumljiva.
Mladen Miki Starčević, naime, od KK-a Split potražuje 97.000 eura na temelju pravomoćne i ovršne presude Općinskog suda u Splitu iz 2010. godine.

Nadalje, u izvješću o financijskom stanju i poslovanju kluba, objavljenom u postupku predstečajne nagodbe 23. rujna 2013. godine na stranicama Fine, Starčević je bio na popisu vjerovnika, uz napomenu da je tada u odnosu na njegovu tražbinu sudski spor bio u tijeku.
No u rješenju kojim se odobrava sklapanje predstečajne nagodbe ne spominje ga se kao vjerovnika. Time je splitski sud obrazložio da trener nema status vjerovnika iz ovršne isprave.
Visoki trgovački sud zbog toga ističe da je odlučna okolnost je li Starčević ovlašten za podnošenje prijedloga za otvaranje stečaja nad Košarkaškim klubom Split. Visoki sud napominje da je vjerovnik za to ovlašten ako učini vjerojatnim postojanje svoje tražbine i stečajnog razloga.
Dok je splitski sud zaključio da trener nema tražbine, Visoki trgovački sud smatra suprotno – da je Starčević učinio vjerojatnim postojanje svoje tražbine koju temelji na ovršnoj i pravomoćnoj presudi, budući da njegova tražbina koju je klub naveo u objavljenom izvješću o financijskom stanju i poslovanju dužnika nije prestala.
Međutim, ta tražbina nije sadržana u kasnijem rješenju kojim se odobrava sklapanje predstečajne nagodbe između kluba i vjerovnika, što ne znači da predlagatelj nema tražbine – mišljenja je viši sud, koji dalje navodi:
– Dakle, Mladen Starčević je ovlašten podnijeti prijedlog za otvaranje stečajnog postupka. O sudbini njegove tražbine odlučit će se tijekom njenog ispitivanja u stečajnom postupku.
Iz Košarkaškog kluba Split samo kažu da ne smiju komentirati rješenje Visokog trgovačkog suda.

Vodstvo Košarkaškog kluba Split možda će ipak morati sjesti za stol sa svojim nekadašnjim trenerom Mladenom Mikijem Starčevićem. Trebali bi se dogovoriti kako će mu, nakon 19 godina, platiti 97.000 eura za njegov rad ili 40 posto tog iznosa, koliki postotak su u predstečajnom postupku dobili ostali vjerovnici.
U suprotnom, klub s Gripa riskira - otvaranje stečaja.
Naime, Visoki trgovački sud ukinuo je rješenje Trgovačkog suda u Splitu o odbačaju prijedloga Mladena Starčevića za otvaranje stečaja nad Košarkaškim klubom Split.
Splitski sud stoga će ponovno morati odlučivati o trenerovu prijedlogu, ali ovaj put uz upute koje je dao viši sud.
Trgovački sud u Splitu je, naime, tvrdio da trener Starčević nije vjerovnik KK-a Split iz ovršene isprave, odnosno da nije naveden u predstečajnoj nagodbi između kluba i njegovih vjerovnika, te da zbog toga nije ovlašten podnositi prijedlog za otvaranje stečaja nad klubom.
No Visoki trgovački sud RH utvrdio je da je rješenje splitskog suda nepravilno i nezakonito jer je izreka presude – nerazumljiva.
Mladen Miki Starčević, naime, od KK-a Split potražuje 97.000 eura na temelju pravomoćne i ovršne presude Općinskog suda u Splitu iz 2010. godine.

Nadalje, u izvješću o financijskom stanju i poslovanju kluba, objavljenom u postupku predstečajne nagodbe 23. rujna 2013. godine na stranicama Fine, Starčević je bio na popisu vjerovnika, uz napomenu da je tada u odnosu na njegovu tražbinu sudski spor bio u tijeku.
No u rješenju kojim se odobrava sklapanje predstečajne nagodbe ne spominje ga se kao vjerovnika. Time je splitski sud obrazložio da trener nema status vjerovnika iz ovršne isprave.
Visoki trgovački sud zbog toga ističe da je odlučna okolnost je li Starčević ovlašten za podnošenje prijedloga za otvaranje stečaja nad Košarkaškim klubom Split. Visoki sud napominje da je vjerovnik za to ovlašten ako učini vjerojatnim postojanje svoje tražbine i stečajnog razloga.
Dok je splitski sud zaključio da trener nema tražbine, Visoki trgovački sud smatra suprotno – da je Starčević učinio vjerojatnim postojanje svoje tražbine koju temelji na ovršnoj i pravomoćnoj presudi, budući da njegova tražbina koju je klub naveo u objavljenom izvješću o financijskom stanju i poslovanju dužnika nije prestala.
Međutim, ta tražbina nije sadržana u kasnijem rješenju kojim se odobrava sklapanje predstečajne nagodbe između kluba i vjerovnika, što ne znači da predlagatelj nema tražbine – mišljenja je viši sud, koji dalje navodi:
– Dakle, Mladen Starčević je ovlašten podnijeti prijedlog za otvaranje stečajnog postupka. O sudbini njegove tražbine odlučit će se tijekom njenog ispitivanja u stečajnom postupku.
Iz Košarkaškog kluba Split samo kažu da ne smiju komentirati rješenje Visokog trgovačkog suda.
