Općinski sud u Splitu uvažio je tužbu odvjetnice Gorane Roso, punomoćnice Joška Siriščevića, koji je obavljao dužnost zamjenika direktora Splitske obale, prije nego je početkom prošle godine dobio "poslovno uvjetovani" otkaz.

Presudom je utvrđeno da je odluka o redovnom otkazu ugovora o radu, koja datira od 18. veljače 2022. godine i kojom je Splitska obala d.o.o. otkazala Sirišćeviću ugovor o radu na neodređeno vrijeme, zaključen 01. veljače 2021. godine, nezakonita i nedopuštena. Također, utvrđuje se da radni odnos tužitelja kod Splitske obale nije prestao.

Spomenutoj gradskoj firmi se nalaže da u roku od osam dana i pod prijetnjom ovrhe vrati Siriščevića na radno mjesto koje "odgovara njegovoj stručnoj spremi i osposobljenosti", kao i da nadoknadi troškove sudskog postupka u iznosu od 3.000 kuna.

Presuda je nepravomoćna i na nju postoji mogućnost žalbe.

Marijan Ciprijan, direktor Splitske obale, je ovu odluku svojevremeno objasnio ovako:

– Nakon stupanja na snagu zabrane iznajmljivanja komunalne opreme –​ bitvi na Zapadnoj obali tvrtka "Splitska obala" d.o.o. je dovedena u nezavidan financijski položaj. Zbog toga smo svim zainteresiranim djelatnicima ponudili otpremnine.

Osom zabrane, tvrtka je dobila i višemilijunsku kaznu za rad bez koncesije na istom području. Siriščević nije jedini koji je tad dobio otkaz. Osim njega, bez posla je ostala i voditeljica pravne službe koja je također podnijela tužbu protiv bivšeg poslodavca.

Općinski sud u Splitu uvažio je tužbu odvjetnice Gorane Roso, punomoćnice Joška Siriščevića, koji je obavljao dužnost zamjenika direktora Splitske obale, prije nego je početkom prošle godine dobio "poslovno uvjetovani" otkaz.

Presudom je utvrđeno da je odluka o redovnom otkazu ugovora o radu, koja datira od 18. veljače 2022. godine i kojom je Splitska obala d.o.o. otkazala Sirišćeviću ugovor o radu na neodređeno vrijeme, zaključen 01. veljače 2021. godine, nezakonita i nedopuštena. Također, utvrđuje se da radni odnos tužitelja kod Splitske obale nije prestao.

Spomenutoj gradskoj firmi se nalaže da u roku od osam dana i pod prijetnjom ovrhe vrati Siriščevića na radno mjesto koje "odgovara njegovoj stručnoj spremi i osposobljenosti", kao i da nadoknadi troškove sudskog postupka u iznosu od 3.000 kuna.

Presuda je nepravomoćna i na nju postoji mogućnost žalbe.

Marijan Ciprijan, direktor Splitske obale, je ovu odluku svojevremeno objasnio ovako:

– Nakon stupanja na snagu zabrane iznajmljivanja komunalne opreme –​ bitvi na Zapadnoj obali tvrtka "Splitska obala" d.o.o. je dovedena u nezavidan financijski položaj. Zbog toga smo svim zainteresiranim djelatnicima ponudili otpremnine.

Osom zabrane, tvrtka je dobila i višemilijunsku kaznu za rad bez koncesije na istom području. Siriščević nije jedini koji je tad dobio otkaz. Osim njega, bez posla je ostala i voditeljica pravne službe koja je također podnijela tužbu protiv bivšeg poslodavca.

Općinski sud u Splitu uvažio je tužbu odvjetnice Gorane Roso, punomoćnice Joška Siriščevića, koji je obavljao dužnost zamjenika direktora Splitske obale, prije nego je početkom prošle godine dobio "poslovno uvjetovani" otkaz.
