Nakon što je Građevinska inspekcija zabranila daljnju izgradnju zida koji je blokirao postojeći protupožarni put prema makarskoj Osejavi, u ponedjeljak u 9 sati održan je očevid kojem su nazočili sudac Slavko Štrbac, vlasnik Prometa d.o.o. Mate Jujnović, po čijem je nalogu zid i sagrađen, državna odvjetnica Margita Tadić, savjetnik za evidenciju gradske imovine i zastupanje Grada Bojan Mileta, geodet Tonći Bauk, dipl.ing.geodezije Ante Radman, odvjetnik tvrtke Promet d.o.o Mateo Barbir te direktor tvrtke Promet d.o.o. Igor Tomašić.

- Ovdje se radilo o predmetu osiguranja dokaza gdje smo trebali fiksirati postojeće stanje u prostoru i vremenu. Stručnjaci definiraju čestice koje su u pitanju i utvrđuju jesu li u prostoru izvršeni određeni građevinski radovi i koji, te je li iz toga proizašla kakva šteta za neku od stranaka u postupku. Ovo je početna faza, mi samo osiguravamo dokaze koji će se eventualno koristiti u možebitnom sudskom postupku.

Poznati dalmatinski poduzetnik prekinuo protupožarni put. Vatrogasci se nadaju dogovoru, on poručuje: ‘Moram se zaštititi. Ja sam iskren, ako sam nekome ostao dužan, neka se javi, dat ću mu duplo!‘

Građevinska inspekcija je zatvorila gradilište, što znači da se ne smiju izvoditi nikakvi građevinski radovi jer se u tom slučaju čini kazneno djelo. Pravilnik o jednostavnim građevinskim radovima dozvoljava podizanje određenih ogradnih zidova u visini od 1 m 60, no za iskope i ostale radove nužno je ishoditi građevinsku dozvolu - rekao nam je sudac Slavko Štrbac.

- Žao mi je da je protupožarni put koji tu postoji već četrdesetak godina izgubio svoju svrhu. Mislim da se problem mogao riješiti i postavljanjem kapije na ulaz koja bi onemogućavala prolaz vozilima. Trenutno je najvažnije u najkraćem mogućem roku napraviti novi put koji će vatrogascima omogućiti najbrži pristup šumi - kazao nam je makarski gradonačelnik Zoran Paunović.

- Danas je održan očevid po prijedlogu predlagatelja Grada Makarska. Za predlagatelja je sporno da se vrši izgradnja zida na zemljištu koje je u vlasništvu tvrtke Promet d.o.o Makarska. Tvrdi se da je takvom izgradnjom zapriječen putni pravac prema Osejavi. Stav tvrtke Promet d.o.o. je da se radi isključivo o privatnom vlasništvu, te o zadiranju u imovinska prava privatnog vlasnika. Ne znam kakav će stav zauzeti Grad, odnosno kakav će postupak pokrenuti protiv tvrtke Promet d.o.o. S obzirom da se ne radi o imovini koja je u vlasništvu Grada, moje je mišljenje da nije nastupila nikakva šteta za grad Makarsku. Stav tvrtke Promet d.o.o. je da nije postojala mogućnost tranzita preko zemljišta koje je u vlasništvu tvrtke jer to zemljište koristi Stanica za tehnički pregled. Ne vidim nikakvu mogućnost da bilo kakav zahtjev bude osnovan u smislu zahtjeva za naknadu štete, vraćanja u prvobitno stanje ili radi utvrđenja nekakvih prava koji, po mom mišljenju, Gradu ne pripadaju - rekao je odvjetnik Mateo Barbir

Put u središte Osejave je zatvoren, a šetači i rekreativci mogu koristiti jedan od puteva "kojima se rjeđe ide". S obzirom da Osejava predstavlja pluća grada, nije čudno da mnogi Makarani zadnjih dana duboko (uz)dišu. Hoće li i Osejava dahnuti dušom, pokazat će vrijeme.

Nakon što je Građevinska inspekcija zabranila daljnju izgradnju zida koji je blokirao postojeći protupožarni put prema makarskoj Osejavi, u ponedjeljak u 9 sati održan je očevid kojem su nazočili sudac Slavko Štrbac, vlasnik Prometa d.o.o. Mate Jujnović, po čijem je nalogu zid i sagrađen, državna odvjetnica Margita Tadić, savjetnik za evidenciju gradske imovine i zastupanje Grada Bojan Mileta, geodet Tonći Bauk, dipl.ing.geodezije Ante Radman, odvjetnik tvrtke Promet d.o.o Mateo Barbir te direktor tvrtke Promet d.o.o. Igor Tomašić.

- Ovdje se radilo o predmetu osiguranja dokaza gdje smo trebali fiksirati postojeće stanje u prostoru i vremenu. Stručnjaci definiraju čestice koje su u pitanju i utvrđuju jesu li u prostoru izvršeni određeni građevinski radovi i koji, te je li iz toga proizašla kakva šteta za neku od stranaka u postupku. Ovo je početna faza, mi samo osiguravamo dokaze koji će se eventualno koristiti u možebitnom sudskom postupku.

Poznati dalmatinski poduzetnik prekinuo protupožarni put. Vatrogasci se nadaju dogovoru, on poručuje: ‘Moram se zaštititi. Ja sam iskren, ako sam nekome ostao dužan, neka se javi, dat ću mu duplo!‘

Građevinska inspekcija je zatvorila gradilište, što znači da se ne smiju izvoditi nikakvi građevinski radovi jer se u tom slučaju čini kazneno djelo. Pravilnik o jednostavnim građevinskim radovima dozvoljava podizanje određenih ogradnih zidova u visini od 1 m 60, no za iskope i ostale radove nužno je ishoditi građevinsku dozvolu - rekao nam je sudac Slavko Štrbac.

- Žao mi je da je protupožarni put koji tu postoji već četrdesetak godina izgubio svoju svrhu. Mislim da se problem mogao riješiti i postavljanjem kapije na ulaz koja bi onemogućavala prolaz vozilima. Trenutno je najvažnije u najkraćem mogućem roku napraviti novi put koji će vatrogascima omogućiti najbrži pristup šumi - kazao nam je makarski gradonačelnik Zoran Paunović.

- Danas je održan očevid po prijedlogu predlagatelja Grada Makarska. Za predlagatelja je sporno da se vrši izgradnja zida na zemljištu koje je u vlasništvu tvrtke Promet d.o.o Makarska. Tvrdi se da je takvom izgradnjom zapriječen putni pravac prema Osejavi. Stav tvrtke Promet d.o.o. je da se radi isključivo o privatnom vlasništvu, te o zadiranju u imovinska prava privatnog vlasnika. Ne znam kakav će stav zauzeti Grad, odnosno kakav će postupak pokrenuti protiv tvrtke Promet d.o.o. S obzirom da se ne radi o imovini koja je u vlasništvu Grada, moje je mišljenje da nije nastupila nikakva šteta za grad Makarsku. Stav tvrtke Promet d.o.o. je da nije postojala mogućnost tranzita preko zemljišta koje je u vlasništvu tvrtke jer to zemljište koristi Stanica za tehnički pregled. Ne vidim nikakvu mogućnost da bilo kakav zahtjev bude osnovan u smislu zahtjeva za naknadu štete, vraćanja u prvobitno stanje ili radi utvrđenja nekakvih prava koji, po mom mišljenju, Gradu ne pripadaju - rekao je odvjetnik Mateo Barbir

- Smatram da je moj odvjetnik sve rekao! - kratko je slučaj prokomentirao i Mate Jujnović.

Put u središte Osejave je zatvoren, a šetači i rekreativci mogu koristiti jedan od puteva "kojima se rjeđe ide". S obzirom da Osejava predstavlja pluća grada, nije čudno da mnogi Makarani zadnjih dana duboko (uz)dišu. Hoće li i Osejava dahnuti dušom, pokazat će vrijeme.
