Zadranin A.P. (38) trebao se 17. studenog javiti na izdržavanje zatvorske kazne u trajanju od godine dana, nakon što je osuđen zbog počinjenog kaznenog djela prijetnje i lažnog uzbunjivanja.

Međutim, u zatvor će tek 17. prosinca i to nakon što je Županijski sud u Zadru uvažio njegovu molbu za odgodom izvršenja kazne zbog vrlo praktičnog razloga. Ovaj Zadranin je, naime, tražio prolongiranje odlaska u zatvor kako bi - pobrao masline!

Kako doznajemo, osuđeni A.P. je 2. studenog preko svog odvjetnika sutkinji izvršenja poslao molbu u kojoj traži da mu se odgodi upućivanje na izdržavanje kazne zatvora jer je njegova majka vlasnica obiteljskog poljoprivrednog gospodarstva u sklopu kojeg imaju maslinik u Gorici. Usred su sezone branja maslina, trebaju i presaditi nove sadnice koje ne trpe odgodu, a prije toga trebaju pripremiti teren za sadnju.

Isto tako, naveo je A.P. dalje u molbi, u tijeku je i preuređenje odnosno renovacija obiteljske kuće na kojoj radove obavljaju on i njegov otac. Svi navedeni radovi trebali bi se dovršiti najkasnije do sredine prosinca 2020., taman za mjesec dana, koliko bi i odgoda bila.

Sutkinja Dijana Grancarić ovu je molbu, ako i dokaze koji su uz nju priloženi, prihvatila kao osnovanu.

"Zakon o izvršenju kazne zatvora kao jedan od razloga za odgodu predviđa i obvezu osuđenika u dovršavanju započetog posla zbog čijeg bi neobavljanja nastala znatna materijalna šteta. Sutkinja izvršenja je stava da u konkretnom slučaju egzistira zakonski osnov te je osuđeniku odgodila njegovo upućivanje na izdržavanje kazne zatvora u trajanju od jednog mjeseca, u kojem vremenu Sud očekuje će osuđenik završiti svoje započete obiteljske poslove, te dana 17. prosinca 2020. nastupiti na izdržavanje kazne zatvora u Zatvor u Zadru - stoji u obrazloženju rješenja od 5. studenog koje je potpisala sutkinja Grancarić.

Osim zbog razloga odgode, ova zadarska priča zanimljiva je i u kontekstu preporuke koju je ministar pravosuđa Ivan Malenica 27. studenog poslao sucima koji odlučuju o izvršenju kazni zatvora. U toj preporuci navedeno je da se, gdje god je to moguće, osuđenicima odgodi početak izvršavanja kazne zbog korona virusa, odnosno zaštite zdravlja i djelatnika zatvorskog sustava i osoba lišenih slobode koje se već nalaze u zatvorima.

Međutim, sutkinja Grancarić s kojom smo jučer razgovarali, kaže kako njezina odluka nema nikakve veze s tom preporukom ministra. Štoviše, izvršni suci su na nedavnom sastanku s ministrom tražili jasnije definiranje tih uputa kojima je isključivo na leđa pojedinih sudaca prebačena odgovornost o tome tko će na odsluženje kazne zatvora, a tko neće zbog korona virusa.

- Odgoda izvršenja kazne pravo je svakog osuđenika i do sada smo je u brojnim slučajevima odobrili, ovo nije ni prvi ni zadnji put. Osuđenici se na nju pozivaju iz brojnih razloga, od smrti člana obitelji ili bolesti, rizične trudnoće, pa do pomoći roditeljima kao što je bilo u ovom slučaju na obiteljskom gospodarstvu. Svaki slučaj je individualan i tako se razmatra, te odobrava ukoliko za to postoji zakonska osnova potkrijepljena dokazima. Mjesec dana u ovom konkretnom slučaju ništa ne znači, najvažnije je da presudi ne prijeti zastara. Sasvim je jasno da se, primjerice, obiteljskom nasilniku, od kojega prijeti opasnost njegovoj žrtvi, odgoda izvršenja kazne nikako ne bi odobrila - kazala nam je sutkinja Grancarić.

Inače, A.P. je osuđen  na godinu dana zatvora zbog prijetnje i lažnog prijavljivanja u ožujku prošle godine kada je nazvao Centar 112 i lažno dojavio kako će jedan ugostiteljski objekt odletjeti u zrak. Uz to je vrijeđao djelatnicu županijskog centra 112 prijetivši joj da će tenkom ući u centar i tamo baciti bombu

Zadranin A.P. (38) trebao se 17. studenog javiti na izdržavanje zatvorske kazne u trajanju od godine dana, nakon što je osuđen zbog počinjenog kaznenog djela prijetnje i lažnog uzbunjivanja.

Međutim, u zatvor će tek 17. prosinca i to nakon što je Županijski sud u Zadru uvažio njegovu molbu za odgodom izvršenja kazne zbog vrlo praktičnog razloga. Ovaj Zadranin je, naime, tražio prolongiranje odlaska u zatvor kako bi - pobrao masline!

Kako doznajemo, osuđeni A.P. je 2. studenog preko svog odvjetnika sutkinji izvršenja poslao molbu u kojoj traži da mu se odgodi upućivanje na izdržavanje kazne zatvora jer je njegova majka vlasnica obiteljskog poljoprivrednog gospodarstva u sklopu kojeg imaju maslinik u Gorici. Usred su sezone branja maslina, trebaju i presaditi nove sadnice koje ne trpe odgodu, a prije toga trebaju pripremiti teren za sadnju.

Isto tako, naveo je A.P. dalje u molbi, u tijeku je i preuređenje odnosno renovacija obiteljske kuće na kojoj radove obavljaju on i njegov otac. Svi navedeni radovi trebali bi se dovršiti najkasnije do sredine prosinca 2020., taman za mjesec dana, koliko bi i odgoda bila.

Sutkinja Dijana Grancarić ovu je molbu, ako i dokaze koji su uz nju priloženi, prihvatila kao osnovanu.

"Zakon o izvršenju kazne zatvora kao jedan od razloga za odgodu predviđa i obvezu osuđenika u dovršavanju započetog posla zbog čijeg bi neobavljanja nastala znatna materijalna šteta. Sutkinja izvršenja je stava da u konkretnom slučaju egzistira zakonski osnov te je osuđeniku odgodila njegovo upućivanje na izdržavanje kazne zatvora u trajanju od jednog mjeseca, u kojem vremenu Sud očekuje će osuđenik završiti svoje započete obiteljske poslove, te dana 17. prosinca 2020. nastupiti na izdržavanje kazne zatvora u Zatvor u Zadru - stoji u obrazloženju rješenja od 5. studenog koje je potpisala sutkinja Grancarić.

Osim zbog razloga odgode, ova zadarska priča zanimljiva je i u kontekstu preporuke koju je ministar pravosuđa Ivan Malenica 27. studenog poslao sucima koji odlučuju o izvršenju kazni zatvora. U toj preporuci navedeno je da se, gdje god je to moguće, osuđenicima odgodi početak izvršavanja kazne zbog korona virusa, odnosno zaštite zdravlja i djelatnika zatvorskog sustava i osoba lišenih slobode koje se već nalaze u zatvorima.

Međutim, sutkinja Grancarić s kojom smo jučer razgovarali, kaže kako njezina odluka nema nikakve veze s tom preporukom ministra. Štoviše, izvršni suci su na nedavnom sastanku s ministrom tražili jasnije definiranje tih uputa kojima je isključivo na leđa pojedinih sudaca prebačena odgovornost o tome tko će na odsluženje kazne zatvora, a tko neće zbog korona virusa.

- Odgoda izvršenja kazne pravo je svakog osuđenika i do sada smo je u brojnim slučajevima odobrili, ovo nije ni prvi ni zadnji put. Osuđenici se na nju pozivaju iz brojnih razloga, od smrti člana obitelji ili bolesti, rizične trudnoće, pa do pomoći roditeljima kao što je bilo u ovom slučaju na obiteljskom gospodarstvu. Svaki slučaj je individualan i tako se razmatra, te odobrava ukoliko za to postoji zakonska osnova potkrijepljena dokazima. Mjesec dana u ovom konkretnom slučaju ništa ne znači, najvažnije je da presudi ne prijeti zastara. Sasvim je jasno da se, primjerice, obiteljskom nasilniku, od kojega prijeti opasnost njegovoj žrtvi, odgoda izvršenja kazne nikako ne bi odobrila - kazala nam je sutkinja Grancarić.

Inače, A.P. je osuđen  na godinu dana zatvora zbog prijetnje i lažnog prijavljivanja u ožujku prošle godine kada je nazvao Centar 112 i lažno dojavio kako će jedan ugostiteljski objekt odletjeti u zrak. Uz to je vrijeđao djelatnicu županijskog centra 112 prijetivši joj da će tenkom ući u centar i tamo baciti bombu

Zadranin A.P. (38) trebao se 17. studenog javiti na izdržavanje zatvorske kazne u trajanju od godine dana, nakon što je osuđen zbog počinjenog kaznenog djela prijetnje i lažnog uzbunjivanja.

Međutim, u zatvor će tek 17. prosinca i to nakon što je Županijski sud u Zadru uvažio njegovu molbu za odgodom izvršenja kazne zbog vrlo praktičnog razloga. Ovaj Zadranin je, naime, tražio prolongiranje odlaska u zatvor kako bi - pobrao masline!

Kako doznajemo, osuđeni A.P. je 2. studenog preko svog odvjetnika sutkinji izvršenja poslao molbu u kojoj traži da mu se odgodi upućivanje na izdržavanje kazne zatvora jer je njegova majka vlasnica obiteljskog poljoprivrednog gospodarstva u sklopu kojeg imaju maslinik u Gorici. Usred su sezone branja maslina, trebaju i presaditi nove sadnice...
