Ako je pothodnik na Ilijinoj glavici mogao ‘raditi’ bez uporabne dozvole od izgradnje 2012. do travnja 2020., kad su se prema tvrdnjama gradske uprave stekli uvjeti za njezino ishođenje, što ne bi mogli i stanari useljavati u novogradnje i prije nego su one osigurale svu zakonom propisanu dokumentaciju?

- Izgrađenu odnosno rekonstruiranu građevinu možete početi koristiti tek nakon što se za tu građevinu izda uporabna dozvola – kažu zakonski propisi, ali ih stanje na terenu svakodnevno demantira.

Koliko su sigurne?

Prijevremenih stambenih zbrinjavanja ima diljem Dalmacije, a nisu se skućili samo nestrpljivi stanari, već su neki objekti prošlog ljeta primili i prve turiste, a pod jesen i prve podstanare.

- Čisto da nekretnina ne stoji prazna, neka se oplođuje dok jednom ne prođe tehnički prijem - šale se Dubrovčani koji su proteklih godina često noću viđali svjetla u višekatnicama i ručnike na balkonima zgrada koje su netom napustili građevinski radnici, a zamijenili ih meštri za fine radove u interijeru i okućnici. Vodi li i tko evidenciju o naseljavanju zgrada i kuća koje još nisu položile testove i riješile ‘papirologiju’, bude li sankcija i kakvih? Na primjeru nedavnih razornih potresa u Turskoj i Siriji, nameće se i pitanje sigurnosti takvih ‘nepregledanih’ zdanja u slučaju elementarne nepogode, požara i drugih ugroza.

- Pravila su stroga, ako u hodniku zgrade recimo fali samo jedan požarni aparat točno na mjestu gdje je projektom predviđen, imat ćete problema. A gdje je tek dokumentacija za tehnički pregled? Treba vam desetak potvrda, od glavnog projekta preko dokaza o svojstvima ugrađenih materijala za svaki pojedini dio građevine, pa ugovor o stručnom nadzoru između investitora i nadzornog inženjera...Uporabnu dozvolu je relativno lako dobiti, izdaje se u roku od osam dana od tehničkog pregleda, ali samo ako se pokaže da je sa zgradom sve jedan kroz jedan, od komunalnih priključaka i uređenja bivšeg gradilišta do toga da novogradnja gabaritima ne odudara od važećih prostornih planova – priča nam neimenovani dubrovački građevinski inženjer koji je i sam svjedočio slučajevima useljenja prije obavljenog tehničkog prijema. Da je netko odgovoran zbog toga sankcioniran, ne sjeća se.

A ako je suditi po reakciji nadležnih institucija, novi stanari građevina bez uporabne dozvole razloga za brigu nemaju, a još manje oni koji su ih pozvali da usele.

Inspektorat prebacio naniže

Na upit što poduzimaju na prevenciji rastuće prakse ‘prijevremenih stanara’, iz Državnog inspektorata odgovaraju s nokta:

- Dozvole za gradnju i uporabu građevina (stambenih zgrada i obiteljskih kuća) izdaju upravni odjeli gradova i županija koji obavljaju poslove prostornog uređenja i graditeljstva na području na kojem se nekretnina nalazi. Slijedom navedenog, za tražene informacije trebali biste se obratiti Dubrovačko-neretvanskoj županiji odnosno Gradu Dubrovniku. Ministarstvo graditeljstva izdaje dozvole za gradnju i uporabu građevina za projekte koji su od državnog značaja – podučili su nas iz Inspektorata, ne spominjući ni ‘s’ od sankcija. Slijedom njihova naputka, javili smo se najjužnijoj županiji ne bi li doznali više o fenomenu. Nakon tjedan dana čekanja, iz Županije nam je stigao uopćen odgovor:

-Nadležnost Dubrovačko-neretvanske županije, to jest županija općenito, kao i nadležnih županijskih upravnih odjela je izdavanje uporabnih dozvola za građevine u trenutku kada navedene građevine ispune sve uvjete zakonski propisane za ishođenje navedene dozvole – poručili su pa kao i Državni inspektorat, dodali kako za građevine od državnog značaja, dozvolu izdaje resor novog vicepremijera Branka Bačića. One od privatnog značaja očigledno prolaze ispod radara i množe se bez nadzora.

Ništa bez uporabne

Bez uporabne dozvole u vlasničkom listu, zgrada ili kuća ne mogu se prodavati niti mijenjati vlasnika te banka ne može, pri podizanju stambenog kredita, upisati hipoteku na nju. Zakon o prostornom uređenju i gradnji iz 2007. proglasio je nelegalnima sve građevine bez uporabne dozvole. Odavno su, barem u teoriji, poznate i novčane kazne za prekršitelje regula. Novčanom kaznom od 25 do 50 tisuća kuna (dakako, preračunato u eure) kaznit će se pravna osoba kao vlasnik građevine ako rabi ili stavi u pogon građevinu bez uporabne dozvole ili je koristi suprotno njezinoj namjeni.

Kazna u rasponu od 15 do 30 tisuća kuna prijeti vlasniku građevine fizička osoba za isti prekršaj.

Ako je pothodnik na Ilijinoj glavici mogao ‘raditi’ bez uporabne dozvole od izgradnje 2012. do travnja 2020., kad su se prema tvrdnjama gradske uprave stekli uvjeti za njezino ishođenje, što ne bi mogli i stanari useljavati u novogradnje i prije nego su one osigurale svu zakonom propisanu dokumentaciju?

- Izgrađenu odnosno rekonstruiranu građevinu možete početi koristiti tek nakon što se za tu građevinu izda uporabna dozvola – kažu zakonski propisi, ali ih stanje na terenu svakodnevno demantira.

Koliko su sigurne?

Prijevremenih stambenih zbrinjavanja ima diljem Dalmacije, a nisu se skućili samo nestrpljivi stanari, već su neki objekti prošlog ljeta primili i prve turiste, a pod jesen i prve podstanare.

- Čisto da nekretnina ne stoji prazna, neka se oplođuje dok jednom ne prođe tehnički prijem - šale se Dubrovčani koji su proteklih godina često noću viđali svjetla u višekatnicama i ručnike na balkonima zgrada koje su netom napustili građevinski radnici, a zamijenili ih meštri za fine radove u interijeru i okućnici. Vodi li i tko evidenciju o naseljavanju zgrada i kuća koje još nisu položile testove i riješile ‘papirologiju’, bude li sankcija i kakvih? Na primjeru nedavnih razornih potresa u Turskoj i Siriji, nameće se i pitanje sigurnosti takvih ‘nepregledanih’ zdanja u slučaju elementarne nepogode, požara i drugih ugroza.

- Pravila su stroga, ako u hodniku zgrade recimo fali samo jedan požarni aparat točno na mjestu gdje je projektom predviđen, imat ćete problema. A gdje je tek dokumentacija za tehnički pregled? Treba vam desetak potvrda, od glavnog projekta preko dokaza o svojstvima ugrađenih materijala za svaki pojedini dio građevine, pa ugovor o stručnom nadzoru između investitora i nadzornog inženjera...Uporabnu dozvolu je relativno lako dobiti, izdaje se u roku od osam dana od tehničkog pregleda, ali samo ako se pokaže da je sa zgradom sve jedan kroz jedan, od komunalnih priključaka i uređenja bivšeg gradilišta do toga da novogradnja gabaritima ne odudara od važećih prostornih planova – priča nam neimenovani dubrovački građevinski inženjer koji je i sam svjedočio slučajevima useljenja prije obavljenog tehničkog prijema. Da je netko odgovoran zbog toga sankcioniran, ne sjeća se.

A ako je suditi po reakciji nadležnih institucija, novi stanari građevina bez uporabne dozvole razloga za brigu nemaju, a još manje oni koji su ih pozvali da usele.

Inspektorat prebacio naniže

Na upit što poduzimaju na prevenciji rastuće prakse ‘prijevremenih stanara’, iz Državnog inspektorata odgovaraju s nokta:

- Dozvole za gradnju i uporabu građevina (stambenih zgrada i obiteljskih kuća) izdaju upravni odjeli gradova i županija koji obavljaju poslove prostornog uređenja i graditeljstva na području na kojem se nekretnina nalazi. Slijedom navedenog, za tražene informacije trebali biste se obratiti Dubrovačko-neretvanskoj županiji odnosno Gradu Dubrovniku. Ministarstvo graditeljstva izdaje dozvole za gradnju i uporabu građevina za projekte koji su od državnog značaja – podučili su nas iz Inspektorata, ne spominjući ni ‘s’ od sankcija. Slijedom njihova naputka, javili smo se najjužnijoj županiji ne bi li doznali više o fenomenu. Nakon tjedan dana čekanja, iz Županije nam je stigao uopćen odgovor:

-Nadležnost Dubrovačko-neretvanske županije, to jest županija općenito, kao i nadležnih županijskih upravnih odjela je izdavanje uporabnih dozvola za građevine u trenutku kada navedene građevine ispune sve uvjete zakonski propisane za ishođenje navedene dozvole – poručili su pa kao i Državni inspektorat, dodali kako za građevine od državnog značaja, dozvolu izdaje resor novog vicepremijera Branka Bačića. One od privatnog značaja očigledno prolaze ispod radara i množe se bez nadzora.

Ništa bez uporabne

Bez uporabne dozvole u vlasničkom listu, zgrada ili kuća ne mogu se prodavati niti mijenjati vlasnika te banka ne može, pri podizanju stambenog kredita, upisati hipoteku na nju. Zakon o prostornom uređenju i gradnji iz 2007. proglasio je nelegalnima sve građevine bez uporabne dozvole. Odavno su, barem u teoriji, poznate i novčane kazne za prekršitelje regula. Novčanom kaznom od 25 do 50 tisuća kuna (dakako, preračunato u eure) kaznit će se pravna osoba kao vlasnik građevine ako rabi ili stavi u pogon građevinu bez uporabne dozvole ili je koristi suprotno njezinoj namjeni.

Kazna u rasponu od 15 do 30 tisuća kuna prijeti vlasniku građevine fizička osoba za isti prekršaj.
