Agencija za zaštitu osobnih podataka (AZOP) izdala je u srijedu preporuku s ključnim zahtjevima koje sudionici izborne promidžbe trebaju poštovati kako bi obrada osobnih podataka ispitanika, odnosno birača, ispunjavala zahtjeve o zaštiti podataka.

Među ključnim točkama su preporuke prema kojima je za svako prikupljanje i obradu osobnih podataka potreban zakoniti pravni temelj, dok su političke stranke, kandidati ili drugi sudionici u ulozi voditelja obrade dužni uskladiti svoja postupanja s načelima iz Opće uredbe o zaštiti podataka.

Podaci o političkim mišljenjima predstavljaju posebnu kategoriju osobnih podataka u smislu odredbi Opće uredbe o zaštiti podataka, a obrada posebnih kategorija osobnih podataka je načelno zabranjena, stoji u preporuci.

Automatizirano donošenje odluka, što uključuje i profiliranje, a koje proizvodi pravne učinke na ispitanika ili na njega znatno utječe, također je načelno zabranjeno, ističu u AZOP-u.

U preporuci pojašnjavaju da izrada profila, povezana sa slanjem ciljanih poruka određenim ispitanicima, može utjecati na njihovo glasovanje te će biti dozvoljena samo uz prethodnu izričitu privolu ispitanika.

Političke stranke, kandidati ili drugi sudionici izborne promidžbe se za potrebe oglašavanja i slanja personaliziranih poruka biračima u pravilu mogu oslanjati na privolu ispitanika ili na legitimni interes jedino ako birači razumno mogu očekivati primanje takvih poruka zbog, primjerice, njihovog odnosa s političkom strankom.

U slučaju ciljanog oglašavanja, glasačima treba pružiti odgovarajuće informacije s objašnjenjem zašto primaju određenu poruku, tko je odgovoran za poruku i način na koji mogu ostvarivati svoja prava, što uključuje i pravo na podnošenje prigovora Agenciji za zaštitu osobnih podataka, stoji u preporuci.

Agencija za zaštitu osobnih podataka (AZOP) izdala je u srijedu preporuku s ključnim zahtjevima koje sudionici izborne promidžbe trebaju poštovati kako bi obrada osobnih podataka ispitanika, odnosno birača, ispunjavala zahtjeve o zaštiti podataka.

Među ključnim točkama su preporuke prema kojima je za svako prikupljanje i obradu osobnih podataka potreban zakoniti pravni temelj, dok su političke stranke, kandidati ili drugi sudionici u ulozi voditelja obrade dužni uskladiti svoja postupanja s načelima iz Opće uredbe o zaštiti podataka.

Podaci o političkim mišljenjima predstavljaju posebnu kategoriju osobnih podataka u smislu odredbi Opće uredbe o zaštiti podataka, a obrada posebnih kategorija osobnih podataka je načelno zabranjena, stoji u preporuci.

Automatizirano donošenje odluka, što uključuje i profiliranje, a koje proizvodi pravne učinke na ispitanika ili na njega znatno utječe, također je načelno zabranjeno, ističu u AZOP-u.

U preporuci pojašnjavaju da izrada profila, povezana sa slanjem ciljanih poruka određenim ispitanicima, može utjecati na njihovo glasovanje te će biti dozvoljena samo uz prethodnu izričitu privolu ispitanika.

Političke stranke, kandidati ili drugi sudionici izborne promidžbe se za potrebe oglašavanja i slanja personaliziranih poruka biračima u pravilu mogu oslanjati na privolu ispitanika ili na legitimni interes jedino ako birači razumno mogu očekivati primanje takvih poruka zbog, primjerice, njihovog odnosa s političkom strankom.

U slučaju ciljanog oglašavanja, glasačima treba pružiti odgovarajuće informacije s objašnjenjem zašto primaju određenu poruku, tko je odgovoran za poruku i način na koji mogu ostvarivati svoja prava, što uključuje i pravo na podnošenje prigovora Agenciji za zaštitu osobnih podataka, stoji u preporuci.

Agencija za zaštitu osobnih podataka (AZOP) izdala je u srijedu preporuku s ključnim zahtjevima koje sudionici izborne promidžbe trebaju poštovati kako bi obrada osobnih podataka ispitanika, odnosno birača, ispunjavala zahtjeve o zaštiti podataka.

Političke stranke, kandidati ili drugi sudionici izborne promidžbe se za potrebe oglašavanja i slanja personaliziranih poruka biračima u pravilu mogu oslanjati na privolu ispitanika ili na legitimni interes jedino ako birači razumno mogu očekivati primanje takvih poruka zbog, primjerice, njihovog odnosa s političkom strankom.

U slučaju ciljanog oglašavanja, glasačima treba pružiti odgovarajuće informacije s objašnjenjem zašto primaju određenu poruku, tko je odgovoran za poruku i način na koji mogu ostvarivati svoja prava, što uključuje i pravo na podnošenje prigovora Agenciji za zaštitu osobnih podataka, stoji u preporuci.
