Bura oko videa kojeg je kandidat aktualne sezone popularnog showa Tvoje lice zvuči poznato Mario Valentić izazvao nakon što je sa sportašem Šimunom Cimermanom ušao u prostor crkve Sveta Mati Slobode na zagrebačkom Jarunu u znak prosvjeda protiv mjera Stožera o zatvaranju teretana i fitness centara još uvijek se ne stišava. Iako se glumac, model i fitness trener javno ispričao te izbrisao spomenuti video s Facebooka iz policije su javili kako će protiv njega ipak ići optužni prijedlog.
- Odmah po zaprimljenim saznanjima, policijski službenici su poduzeli sve mjere i radnje propisane zakonom kojom prilikom je utvrđeno da se radi o protupravnom ponašanju opisanom u člancima 6. i 14. Zakona o prekršajima protiv javnog reda i mira, dok je kriminalističko istraživanje u tijeku, a po završetku istoga protiv prekršitelja zakona će biti podnesen optužni prijedlog nadležnom sudu, kazali su u MUP-u za 24 sata.
Za komentar smo zamolili odvjetnika Antu Nobila koji nam je rekao kako kazne za remećenje javnog reda i mira nisu visoke te se kreću oko sto eura, odnosno oko 750 kuna.
- U ovom postupku će sve ovisiti o raspravi. Naime, ako bi se ovo što je Mario Valentić napravio tretiralo kao performans kojim pokazuje svoj protest prema Crkvi u kojoj je dozvoljeno okupljanje vjernika, dok u teretanama nije, onda ima dobre šanse da dobije proces. Pogotovo ako se dokaže da je riječ o političkom procesu. Ako pak prevagne stajalište da je njegov čin nedopustiv, jer Crkva ima svoju namjenu, te da građani Hrvatske u njoj očekuju uobičajne protokole regulirane kanonskim pravom, može se dogoditi da se utvrdi prekršaj remećenja javnog reda i mira, ističe Nobilo.

Kao bivši sportaš shvaća i podupire Valentićev potez.
- Ovo je slučaj kakav se dosad nije dogodio u Hrvatskoj. U potpunosti podupirem Marija jer smatram da je Crkva od početka pandemije privilegirana te da je vlast tolerira više nego bilo koji drugi organ u našoj zemlji. Pa sjetimo se samo procesije na Hvaru dok smo svi bili pod ključem, proslave Velike Gospe u Sinju… Shvaćam, dakle, Valentića i njegovu želju, na kraju krajeva, prijatelj i on nisu ometali misu, bili su u praznoj Crkvi, tako da mislim da bi mogli imati sasvim solidnu obranu.
Ranije se oglasio i don Damir Stojić koji je ovu situaciju prokomentirao kao grubu povredu svetog prostora.
- Kao župnik, svećenik, vjernik i čovjek dijelim vaše osjećaje i emocije koje ste mi prenijeli putem stotine poruka i mailova sinoć pa i danas, a to su ljutnja, razočarenje, uvreda, ali ponajviše žalost. Oče, oprosti im, ne znaju što čine!, poručio je Stojić dok je čelnik katoličke udruge Vigilare Vice John Batarelo bio još oštriji te je Valentićev potez nazvao dijaboličkim oskvrnućem.
- Ovo nije samo diskriminacija nego što više divljaštvo i napad na Katoličku Crkvu i vjernike u Hrvatskoj koje nismo vidjeli od Domovinskog rata, kazao je Batarelo.

Što kaže zakon?
Ako policija utvrdi da je neka osoba svojim ponašanjem narušila javni red i mir, protiv nje će pokrenuti prekršajni postupak izdavanjem prekršajnog naloga ili podnošenjem optužnog prijedloga.
Osobe oštećene prekršajem mogu same pokrenuti prekršajni postupak podnošenjem optužnog prijedloga pred mjesno nadležnim prekršajnim sudom.
Za prekršaje iz područja javnog reda i mira zaprijećena je novčana kazna ili kazna zatvora do 30 dana, a sukladno zakonu počinitelju se mogu odrediti i zaštitne mjere.

- Odmah po zaprimljenim saznanjima, policijski službenici su poduzeli sve mjere i radnje propisane zakonom kojom prilikom je utvrđeno da se radi o protupravnom ponašanju opisanom u člancima 6. i 14. Zakona o prekršajima protiv javnog reda i mira, dok je kriminalističko istraživanje u tijeku, a po završetku istoga protiv prekršitelja zakona će biti podnesen optužni prijedlog nadležnom sudu, kazali su u MUP-u za 24 sata.
Za komentar smo zamolili odvjetnika Antu Nobila koji nam je rekao kako kazne za remećenje javnog reda i mira nisu visoke te se kreću oko sto eura, odnosno oko 750 kuna.
- U ovom postupku će sve ovisiti o raspravi. Naime, ako bi se ovo što je Mario Valentić napravio tretiralo kao performans kojim pokazuje svoj protest prema Crkvi u kojoj je dozvoljeno okupljanje vjernika, dok u teretanama nije, onda ima dobre šanse da dobije proces. Pogotovo ako se dokaže da je riječ o političkom procesu. Ako pak prevagne stajalište da je njegov čin nedopustiv, jer Crkva ima svoju namjenu, te da građani Hrvatske u njoj očekuju uobičajne protokole regulirane kanonskim pravom, može se dogoditi da se utvrdi prekršaj remećenja javnog reda i mira, ističe Nobilo.

Kao bivši sportaš shvaća i podupire Valentićev potez.
- Ovo je slučaj kakav se dosad nije dogodio u Hrvatskoj. U potpunosti podupirem Marija jer smatram da je Crkva od početka pandemije privilegirana te da je vlast tolerira više nego bilo koji drugi organ u našoj zemlji. Pa sjetimo se samo procesije na Hvaru dok smo svi bili pod ključem, proslave Velike Gospe u Sinju… Shvaćam, dakle, Valentića i njegovu želju, na kraju krajeva, prijatelj i on nisu ometali misu, bili su u praznoj Crkvi, tako da mislim da bi mogli imati sasvim solidnu obranu.
Ranije se oglasio i don Damir Stojić koji je ovu situaciju prokomentirao kao grubu povredu svetog prostora.
- Kao župnik, svećenik, vjernik i čovjek dijelim vaše osjećaje i emocije koje ste mi prenijeli putem stotine poruka i mailova sinoć pa i danas, a to su ljutnja, razočarenje, uvreda, ali ponajviše žalost. Oče, oprosti im, ne znaju što čine!, poručio je Stojić dok je čelnik katoličke udruge Vigilare Vice John Batarelo bio još oštriji te je Valentićev potez nazvao dijaboličkim oskvrnućem.
- Ovo nije samo diskriminacija nego što više divljaštvo i napad na Katoličku Crkvu i vjernike u Hrvatskoj koje nismo vidjeli od Domovinskog rata, kazao je Batarelo.

Što kaže zakon?
Ako policija utvrdi da je neka osoba svojim ponašanjem narušila javni red i mir, protiv nje će pokrenuti prekršajni postupak izdavanjem prekršajnog naloga ili podnošenjem optužnog prijedloga.
Osobe oštećene prekršajem mogu same pokrenuti prekršajni postupak podnošenjem optužnog prijedloga pred mjesno nadležnim prekršajnim sudom.
Za prekršaje iz područja javnog reda i mira zaprijećena je novčana kazna ili kazna zatvora do 30 dana, a sukladno zakonu počinitelju se mogu odrediti i zaštitne mjere.
