Nakon što je skupina osumnjičenih za pogodovanja i zlouporabe u području prostornog planiranja, bespravne gradnje i legalizacije na području južne Istre, u utorak ispitana u riječkom Odsjeku USKOK-a, USKOK je u srijedu donio rješenje o provođenju istrage protiv 15 državljana Hrvatske, 10 državljana Slovenije i jednog državljanina Srbije zbog osnovane sumnje na počinjenje kaznenih djela zlouporabe položaja i ovlasti, poticanja i pomaganja u zlouporabi položaja i ovlasti, krivotvorenja službene ili poslovne isprave te krivotvorenja isprave, piše Jutarnji list.

Hina piše da se u utorak neslužbeno doznalo da su među osobama koje su u utorak ispitane u riječkom Odsjeku USKOK-a i bivša voditeljica Odjela za prostorno planiranje i gradnju Dora Komparić i bivši pročelnik za urbanizam Grada Vodnjana Damir Janko.

- Osnovano se sumnja da je, od 2014. do 2019. godine, u Vodnjanu, I. okr. kao savjetnica za prostorno planiranje i gradnju pri Upravnom odjelu za komunalni sustav, prostorno uređenje i imovinske poslove Grada Vodnjana, rješavajući zahtjeve za legalizaciju bespravno izgrađenih zgrada u katastarskim općinama Vodnjan i Peroj, na traženje vlasnika nekretnina u upravnim predmetima Grada Vodnjana donosila rješenja o izvedenom stanju kojima su, protivno Zakonu o postupanju s nezakonito izgrađenim zgradama, legalizirane nezakonito izgrađene zgrade ili zgrade koje će se tek izgraditi, iako je bila svjesna da se radi o zgradama koje sukladno navedenom zakonu ne mogu biti legalizirane jer su izgrađene nakon 21. lipnja 2011. ili nisu uopće izgrađene ili ne udovoljavaju drugim uvjetima propisanim tim zakonom, navodi pak USKOK.

Na taj je način I okr., nakon što su to od nje zatražili II., V. do VII. te IX. do XXII. okr. kao vlasnici nekretnina na kojima su ilegalni objekti izgrađeni ili se tek trebaju izgraditi, odnosno njihovi punomoćnici i druge osobe, omogućila zadržavanje nezakonito izgrađenih zgrada u prostoru, dok je u pojedinim slučajevima onemogućila donošenje ili provedbu rješenja za uklanjanje ilegalnog objekta. Ujedno je vlasnicima takvih zgrada pribavila znatnu imovinsku korist povećanjem vrijednosti nekretnina koja se očituje u razlici vrijednosti zemljišta bez izgrađenog objekta i s izgrađenim objektom.

Tako je I. okr. donijela rješenja o izvedenom stanju u najmanje 16 upravnih predmeta u kojima su zaprimljeni zahtjevi za legalizaciju bespravno izgrađenih zgrada, a pritom se prema potrebi koristila nevjerodostojnim ispravama priloženim uz pojedini zahtjev ili ih je sama izrađivala kao podlogu za odlučivanje s neistinito prikazanim stanjem na terenu. Pojedine isprave koje je koristila u upravnim predmetima izrađivali su i III. okr. kao ovlašteni inženjer geodezije, IV. okr. kao ovlašteni inženjer građevinarstva, VIII. okr. kao ovlašteni arhitekt, IX. okr. kao suradnik ovlaštenog arhitekta, XXIII. okr. kao suradnica ovlaštene arhitektice te XXIV. okr. kao ovlaštena arhitektica.

Na opisani način vlasnicima nekretnina pribavljena je materijalna korist od najmanje 4.513.755,39 kuna.

Nadalje se osnovano sumnja da su, u razdoblju od 2015. do 2017. godine, u Vodnjanu, II. okr. kao pročelnik Upravnog odjela za komunalni sustav, prostorno uređenje i imovinske poslove Grada Vodnjana te I. okr. kao savjetnica za prostorno planiranje i gradnju u istom Odjelu, oboje postupajući po zahtjevima za legalizaciju bespravno izgrađenih zgrada u katastarskoj općini Peroj, na traženje XXV. i XXVI. okr. kao vlasnika nekretnina, donosili ili nalagali donošenje rješenja o izvedenom stanju u najmanje dva upravna predmeta Grada Vodnjana kojima se protivno zakonu ozakonjuju nezakonito izgrađene zgrade ili zgrade koje će se tek izgraditi, iako su bili svjesni da se radi o zgradama koje ne mogu biti legalizirane jer je to u suprotnosti s odredbama Zakona o postupanju s nezakonito izgrađenim zgradama jer su izgrađene nakon 21. lipnja 2011. ili uopće nisu izgrađene. Kao podlogu za odlučivanje također su koristili nevjerodostojne isprave ili su ih sami izrađivali.

Na opisani način vlasnicima nekretnina pribavljena je materijalna korist od najmanje 297.655,36 kuna.

USKOK je sucu istrage Županijskog suda u Rijeci predložio određivanje istražnog zatvora protiv dvoje okrivljenika - stoji u USKOK-ovu rješenju.

Nakon što je skupina osumnjičenih za pogodovanja i zlouporabe u području prostornog planiranja, bespravne gradnje i legalizacije na području južne Istre, u utorak ispitana u riječkom Odsjeku USKOK-a, USKOK je u srijedu donio rješenje o provođenju istrage protiv 15 državljana Hrvatske, 10 državljana Slovenije i jednog državljanina Srbije zbog osnovane sumnje na počinjenje kaznenih djela zlouporabe položaja i ovlasti, poticanja i pomaganja u zlouporabi položaja i ovlasti, krivotvorenja službene ili poslovne isprave te krivotvorenja isprave, piše Jutarnji list.

Hina piše da se u utorak neslužbeno doznalo da su među osobama koje su u utorak ispitane u riječkom Odsjeku USKOK-a i bivša voditeljica Odjela za prostorno planiranje i gradnju Dora Komparić i bivši pročelnik za urbanizam Grada Vodnjana Damir Janko.

- Osnovano se sumnja da je, od 2014. do 2019. godine, u Vodnjanu, I. okr. kao savjetnica za prostorno planiranje i gradnju pri Upravnom odjelu za komunalni sustav, prostorno uređenje i imovinske poslove Grada Vodnjana, rješavajući zahtjeve za legalizaciju bespravno izgrađenih zgrada u katastarskim općinama Vodnjan i Peroj, na traženje vlasnika nekretnina u upravnim predmetima Grada Vodnjana donosila rješenja o izvedenom stanju kojima su, protivno Zakonu o postupanju s nezakonito izgrađenim zgradama, legalizirane nezakonito izgrađene zgrade ili zgrade koje će se tek izgraditi, iako je bila svjesna da se radi o zgradama koje sukladno navedenom zakonu ne mogu biti legalizirane jer su izgrađene nakon 21. lipnja 2011. ili nisu uopće izgrađene ili ne udovoljavaju drugim uvjetima propisanim tim zakonom, navodi pak USKOK.

Na taj je način I okr., nakon što su to od nje zatražili II., V. do VII. te IX. do XXII. okr. kao vlasnici nekretnina na kojima su ilegalni objekti izgrađeni ili se tek trebaju izgraditi, odnosno njihovi punomoćnici i druge osobe, omogućila zadržavanje nezakonito izgrađenih zgrada u prostoru, dok je u pojedinim slučajevima onemogućila donošenje ili provedbu rješenja za uklanjanje ilegalnog objekta. Ujedno je vlasnicima takvih zgrada pribavila znatnu imovinsku korist povećanjem vrijednosti nekretnina koja se očituje u razlici vrijednosti zemljišta bez izgrađenog objekta i s izgrađenim objektom.

Tako je I. okr. donijela rješenja o izvedenom stanju u najmanje 16 upravnih predmeta u kojima su zaprimljeni zahtjevi za legalizaciju bespravno izgrađenih zgrada, a pritom se prema potrebi koristila nevjerodostojnim ispravama priloženim uz pojedini zahtjev ili ih je sama izrađivala kao podlogu za odlučivanje s neistinito prikazanim stanjem na terenu. Pojedine isprave koje je koristila u upravnim predmetima izrađivali su i III. okr. kao ovlašteni inženjer geodezije, IV. okr. kao ovlašteni inženjer građevinarstva, VIII. okr. kao ovlašteni arhitekt, IX. okr. kao suradnik ovlaštenog arhitekta, XXIII. okr. kao suradnica ovlaštene arhitektice te XXIV. okr. kao ovlaštena arhitektica.

Na opisani način vlasnicima nekretnina pribavljena je materijalna korist od najmanje 4.513.755,39 kuna.

Nadalje se osnovano sumnja da su, u razdoblju od 2015. do 2017. godine, u Vodnjanu, II. okr. kao pročelnik Upravnog odjela za komunalni sustav, prostorno uređenje i imovinske poslove Grada Vodnjana te I. okr. kao savjetnica za prostorno planiranje i gradnju u istom Odjelu, oboje postupajući po zahtjevima za legalizaciju bespravno izgrađenih zgrada u katastarskoj općini Peroj, na traženje XXV. i XXVI. okr. kao vlasnika nekretnina, donosili ili nalagali donošenje rješenja o izvedenom stanju u najmanje dva upravna predmeta Grada Vodnjana kojima se protivno zakonu ozakonjuju nezakonito izgrađene zgrade ili zgrade koje će se tek izgraditi, iako su bili svjesni da se radi o zgradama koje ne mogu biti legalizirane jer je to u suprotnosti s odredbama Zakona o postupanju s nezakonito izgrađenim zgradama jer su izgrađene nakon 21. lipnja 2011. ili uopće nisu izgrađene. Kao podlogu za odlučivanje također su koristili nevjerodostojne isprave ili su ih sami izrađivali.

Na opisani način vlasnicima nekretnina pribavljena je materijalna korist od najmanje 297.655,36 kuna.

USKOK je sucu istrage Županijskog suda u Rijeci predložio određivanje istražnog zatvora protiv dvoje okrivljenika - stoji u USKOK-ovu rješenju.

Nakon što je skupina osumnjičenih za pogodovanja i zlouporabe u području prostornog planiranja, bespravne gradnje i legalizacije na području južne Istre, u utorak ispitana u riječkom Odsjeku USKOK-a, USKOK je u srijedu donio rješenje o provođenju istrage protiv 15 državljana Hrvatske, 10 državljana Slovenije i jednog državljanina Srbije zbog osnovane sumnje na počinjenje kaznenih djela zlouporabe položaja i ovlasti, poticanja i pomaganja u zlouporabi položaja i ovlasti, krivotvorenja službene ili poslovne isprave te krivotvorenja isprave, piše Jutarnji list.
