Europski sud za ljudska prava (ESLJP) presudio je da je Hrvatska povrijedila ljudska prava zatvorenika jer nije provela učinkovitu istragu o njegovu zlostavljanju u zatvoru, odnosno incidentu u kojem je teško ozlijeđen tijekom intervencije zatvorskih čuvara.

Podnositelj zahtjeva prigovorio je zbog uporabe prekomjerne sile koju su prema njemu upotrijebili pravosudni policajci u listopadu 2016. tijekom pregleda ćelije u Zatvoru u Splitu gdje je izdržavao kaznu.

Istu večer nakon incidenta odveden je u bolnicu gdje mu je dijagnosticiran prijelom dva rebra, više ogrebotina i tragova udaraca na lijevoj strani prsnog koša, na području vrata i glave, zbog čega je operiran i ostao hospitaliziran u bolnici osam dana.

Općinsko državno odvjetništvo u Splitu je tijekom istrage pribavilo zapisnik o očevidu i medicinsko vještačenje. U siječnju 2018. odbacilo je podnositeljevu kaznenu prijavu zaključivši da, budući da je medicinsko vještačenje dopustilo mogućnost različitih načina nastanka ozljeda, nema osnovane sumnje da su mu pravosudni policajci namjerno nanijeli teške tjelesne ozljede.

Premda podnositelj nije preuzeo kazneni progon i nije podnio ustavnu tužbu, Europski sud je ocijenio da je njegov zahtjev dopušten zato što je ustavna tužba tek 2019. godine postala učinkovito domaće pravno sredstvo za pritužbe koje se odnose na neučinkovite istrage, izvijestio je ured hrvatske predstavnice pred sudom u Strasbourgu.

ESLJP je primijetio da istraga nije pokrenuta neposredno nakon događaja, već tek na temelju naknadne kaznene prijave šest mjeseci kasnije. Državno odvjetništvo je prijavu odbacilo bez pažljivog ispitivanja svih relevantnih činjenica i bez ispitivanja podnositelja i zatvorskih čuvara, iako je raspolagalo medicinskim vještačenjem koje je dopuštalo nekoliko različitih scenarija o mogućim uzrocima ozljeda podnositelja.

Stoga je zaključio da istraga nije bila temeljito provedena, što je uzrokovalo povredu Konvencije o zaštiti ljudskih prava i temeljnih sloboda u postupovnom aspektu. Sud je smatrao da je podnositelj iznio dovoljno elemenata za stvaranje snažne pretpostavke o tome da je pretrpio teške tjelesne ozljede na način da su ga zatvorski čuvari udarali šakama i nogama dok je nepokretan ležao na podu zatvorske ćelije, uslijed čega je operiran i hospitaliziran.

S obzirom da Hrvatska nije iznijela uvjerljivo objašnjenje da su pretrpljene ozljede nastale na drugačiji način niti je istraga bila provedena u skladu s konvencijskim standardima, sud je utvrdio da je došlo i do povrede Konvencije u materijalnom aspektu, navode u priopćenju.

Europski sud je konačnom presudom dosudio podnositelju odštetu od 12.000 eura na ime nematerijalne štete i 3000 eura na ime troškova postupka.

Europski sud za ljudska prava (ESLJP) presudio je da je Hrvatska povrijedila ljudska prava zatvorenika jer nije provela učinkovitu istragu o njegovu zlostavljanju u zatvoru, odnosno incidentu u kojem je teško ozlijeđen tijekom intervencije zatvorskih čuvara.

Podnositelj zahtjeva prigovorio je zbog uporabe prekomjerne sile koju su prema njemu upotrijebili pravosudni policajci u listopadu 2016. tijekom pregleda ćelije u Zatvoru u Splitu gdje je izdržavao kaznu.

Istu večer nakon incidenta odveden je u bolnicu gdje mu je dijagnosticiran prijelom dva rebra, više ogrebotina i tragova udaraca na lijevoj strani prsnog koša, na području vrata i glave, zbog čega je operiran i ostao hospitaliziran u bolnici osam dana.

Općinsko državno odvjetništvo u Splitu je tijekom istrage pribavilo zapisnik o očevidu i medicinsko vještačenje. U siječnju 2018. odbacilo je podnositeljevu kaznenu prijavu zaključivši da, budući da je medicinsko vještačenje dopustilo mogućnost različitih načina nastanka ozljeda, nema osnovane sumnje da su mu pravosudni policajci namjerno nanijeli teške tjelesne ozljede.

Premda podnositelj nije preuzeo kazneni progon i nije podnio ustavnu tužbu, Europski sud je ocijenio da je njegov zahtjev dopušten zato što je ustavna tužba tek 2019. godine postala učinkovito domaće pravno sredstvo za pritužbe koje se odnose na neučinkovite istrage, izvijestio je ured hrvatske predstavnice pred sudom u Strasbourgu.

ESLJP je primijetio da istraga nije pokrenuta neposredno nakon događaja, već tek na temelju naknadne kaznene prijave šest mjeseci kasnije. Državno odvjetništvo je prijavu odbacilo bez pažljivog ispitivanja svih relevantnih činjenica i bez ispitivanja podnositelja i zatvorskih čuvara, iako je raspolagalo medicinskim vještačenjem koje je dopuštalo nekoliko različitih scenarija o mogućim uzrocima ozljeda podnositelja.

Stoga je zaključio da istraga nije bila temeljito provedena, što je uzrokovalo povredu Konvencije o zaštiti ljudskih prava i temeljnih sloboda u postupovnom aspektu. Sud je smatrao da je podnositelj iznio dovoljno elemenata za stvaranje snažne pretpostavke o tome da je pretrpio teške tjelesne ozljede na način da su ga zatvorski čuvari udarali šakama i nogama dok je nepokretan ležao na podu zatvorske ćelije, uslijed čega je operiran i hospitaliziran.

S obzirom da Hrvatska nije iznijela uvjerljivo objašnjenje da su pretrpljene ozljede nastale na drugačiji način niti je istraga bila provedena u skladu s konvencijskim standardima, sud je utvrdio da je došlo i do povrede Konvencije u materijalnom aspektu, navode u priopćenju.

Europski sud je konačnom presudom dosudio podnositelju odštetu od 12.000 eura na ime nematerijalne štete i 3000 eura na ime troškova postupka.

Europski sud za ljudska prava (ESLJP) presudio je da je Hrvatska povrijedila ljudska prava zatvorenika jer nije provela učinkovitu istragu o njegovu zlostavljanju u zatvoru, odnosno incidentu u kojem je teško ozlijeđen tijekom intervencije zatvorskih čuvara.

Podnositelj zahtjeva prigovorio je zbog uporabe prekomjerne sile koju su prema njemu upotrijebili pravosudni policajci u listopadu 2016. tijekom pregleda ćelije u Zatvoru u Splitu gdje je izdržavao kaznu.

Istu večer nakon incidenta odveden je u bolnicu gdje mu je dijagnosticiran prijelom dva rebra, više ogrebotina i tragova udaraca na lijevoj strani prsnog koša, na području vrata i glave, zbog čega je operiran i ostao hospitaliziran u bolnici osam dana.

Općinsko državno odvjetništvo u Splitu je tijekom istrage pribavilo zapisnik o očevidu i medicinsko vještačenje. U siječnju 2018. odbacilo je podnositeljevu kaznenu prijavu zaključivši da, budući da je medicinsko vještačenje dopustilo mogućnost različitih načina nastanka ozljeda, nema osnovane sumnje da su mu pravosudni policajci namjerno nanijeli teške tjelesne ozljede.

Premda podnositelj nije preuzeo kazneni progon i nije podnio ustavnu tužbu, Europski sud je ocijenio da je njegov zahtjev dopušten zato što je ustavna tužba tek 2019. godine postala učinkovito domaće pravno sredstvo za pritužbe koje se odnose na neučinkovite istrage, izvijestio je ured hrvatske predstavnice pred sudom u Strasbourgu.
