Na temu devastacije pomorskog dobra ispod Hotela Rixos Premium Dubrovnik, na koju nas je upozorio čitatelj i poslao nam fotografije devastacije, poslali smo upite nadležnim službama koje je u svom odgovoru naznačila Županija. Iz Županije smo, naime, vrlo brzo dobili odgovor da ‘nisu izdavali nikakva odobrenja za ove radove‘ te su nas uputili na druge nadležne institucije.

- U konkretnom slučaju iz Vašeg upita riječ je o devastaciji pomorskog dobra, a za što je nadležna Lučka kapetanija.

Iz Lučke kapetanije nisu smjeli komentirati slučaj bez svog krovnog Ministarstva, od kojeg smo nakon nekoliko dana dobili odgovor u vezi betonizacije obale ispod Hotela Rixos.

- Temeljem predstavke građana, Odjel inspekcijskih poslova Lučke kapetanije Dubrovnik je 6. lipnja 2023. godine izvršio inspekcijski nadzor dijela pomorskog dobra pod upravljanjem ovlaštenika koncesije - trgovačkog društva „Hotel Libertas“ d.o.o. u  Dubrovniku, kojim je utvrđeno da je predmetno trgovačko društvo koristilo dio pomorskog dobra unutar koncesioniranog područja, kojeg u naravi čini dio č.z. 1877/3 K.O. Dubrovnik, na način da je tijekom mjeseca travnja 2023. godine, bez suglasnosti davatelja koncesije, izgradilo pet kaskadnih platoa od kamenih ploča i betonskih ispuna (fuga), što je u suprotnosti s odredbama Ugovora o koncesiji između davatelja koncesije i ovlaštenika koncesije, odnosno što je izvršeno u suprotnosti s odredbama Zakona o pomorskom dobru i morskim lukama te je inspektor Lučke kapetanije Dubrovnik izdao rješenje kojim se koncesionaru zabranilo sve daljnje radove i korištenje predmetnog pomorskog dobra suprotno odredbama važećeg ugovora, obavijestio davatelja koncesije i nadležnu područnu jedinicu Državnog inspektorata te je podnio optužni prijedlog protiv pravne i odgovorne osobe trgovačkog društva nadležnom Vijeću za prekršaje Lučke kapetanije Dubrovnik - odgovorili su iz Ministarstva. Kolike su kazne, hoće li one biti izrečene i na koji način provedene, te hoće li pomorsko dobro biti vraćeno u prvobitno stanje iz odgovora je ostalo nejasno.

No, investitor ima razloga za zabrinutost - novi Zakon o pomorskom dobru  sprema velike promjene, od inspekcijskih ovlasti za komunalne redare i lučke kapetanije pa do vrtoglavih kazni i rušenja postojećih građevina.

Kako je to rekao za Dnevnik.hr na ovu temu krajem prošle godine Josip Bilaver iz Ministarstva mora, prometa i infrastrukture, ‘za nezakonitu gradnju, recimo, jednog mula kazna seže i do 130 tisuća eura. Ono što je napravljeno na pomorskom dobru, a nije u prostornim planovima općina i gradova, bit će uklonjeno‘, upozorio je tada.

Na temu devastacije pomorskog dobra ispod Hotela Rixos Premium Dubrovnik, na koju nas je upozorio čitatelj i poslao nam fotografije devastacije, poslali smo upite nadležnim službama koje je u svom odgovoru naznačila Županija. Iz Županije smo, naime, vrlo brzo dobili odgovor da ‘nisu izdavali nikakva odobrenja za ove radove‘ te su nas uputili na druge nadležne institucije.

- U konkretnom slučaju iz Vašeg upita riječ je o devastaciji pomorskog dobra, a za što je nadležna Lučka kapetanija.

Iz Lučke kapetanije nisu smjeli komentirati slučaj bez svog krovnog Ministarstva, od kojeg smo nakon nekoliko dana dobili odgovor u vezi betonizacije obale ispod Hotela Rixos.

- Temeljem predstavke građana, Odjel inspekcijskih poslova Lučke kapetanije Dubrovnik je 6. lipnja 2023. godine izvršio inspekcijski nadzor dijela pomorskog dobra pod upravljanjem ovlaštenika koncesije - trgovačkog društva „Hotel Libertas“ d.o.o. u  Dubrovniku, kojim je utvrđeno da je predmetno trgovačko društvo koristilo dio pomorskog dobra unutar koncesioniranog područja, kojeg u naravi čini dio č.z. 1877/3 K.O. Dubrovnik, na način da je tijekom mjeseca travnja 2023. godine, bez suglasnosti davatelja koncesije, izgradilo pet kaskadnih platoa od kamenih ploča i betonskih ispuna (fuga), što je u suprotnosti s odredbama Ugovora o koncesiji između davatelja koncesije i ovlaštenika koncesije, odnosno što je izvršeno u suprotnosti s odredbama Zakona o pomorskom dobru i morskim lukama te je inspektor Lučke kapetanije Dubrovnik izdao rješenje kojim se koncesionaru zabranilo sve daljnje radove i korištenje predmetnog pomorskog dobra suprotno odredbama važećeg ugovora, obavijestio davatelja koncesije i nadležnu područnu jedinicu Državnog inspektorata te je podnio optužni prijedlog protiv pravne i odgovorne osobe trgovačkog društva nadležnom Vijeću za prekršaje Lučke kapetanije Dubrovnik - odgovorili su iz Ministarstva. Kolike su kazne, hoće li one biti izrečene i na koji način provedene, te hoće li pomorsko dobro biti vraćeno u prvobitno stanje iz odgovora je ostalo nejasno.

No, investitor ima razloga za zabrinutost - novi Zakon o pomorskom dobru  sprema velike promjene, od inspekcijskih ovlasti za komunalne redare i lučke kapetanije pa do vrtoglavih kazni i rušenja postojećih građevina.

Kako je to rekao za Dnevnik.hr na ovu temu krajem prošle godine Josip Bilaver iz Ministarstva mora, prometa i infrastrukture, ‘za nezakonitu gradnju, recimo, jednog mula kazna seže i do 130 tisuća eura. Ono što je napravljeno na pomorskom dobru, a nije u prostornim planovima općina i gradova, bit će uklonjeno‘, upozorio je tada.
